The bankruptcy trustee of Izabela Szpunar in the proceedings BB1B/GUp-s/557/2023 announces the sale of a share in real estate by free hand (in the form of a tender) and invites offers for the purchase of a share in the land property. The asset of the bankruptcy estate consists of a 1/3 share in the land property. The land property consists of four land plots with numbers 2688/1, 2688/2, 2688/25, 3457/7 with a total area of 1.0377 ha, located in the Silesian Voivodeship, in the town of Bielsko-Biala, precinct 0007 Halcnów. For the subject plot, a land and mortgage register number BB1B/00032955/9 has been established, maintained by the District Court in Bielsko-Biala, VII Land and Mortgage Register Department. The total value of the property has been estimated at 165,721 PLN, thus the value of the bankrupt's share is: 55,240.33 PLN. The offered purchase price for the share in the property cannot be lower than 25% of the value of the bankrupt's share, which is 13,810.08 PLN. The land property has been described and included in the inventory list, and a detailed description and valuation can be found in the valuation report of the property appraiser. The valuation report is available in the case files under BB1B/GUp-s/557/2023/66. The deposit amounts to 10% of the estimated value of the property and is 1,381.01 PLN (in words: one thousand three hundred eighty-one 01/100). The deadline for submitting offers expires on 02.09.2025. The opening of offers will take place on 03.09.2025 at 12:00 at the Trustee's Office, ul. Cieszyńska 365, room 203. All inquiries are accepted by mail at the Trustee's Office (ul. Michałowicza 12, 43-300 Bielsko-Biala) or electronically via the email address indicated in the further part of the announcement. General information about the tender is also provided personally by the trustee at the phone number indicated in the further part of the announcement. Interested parties are requested to submit offers in accordance with the Sales Regulations. The trustee reserves the right to withdraw from the sale at any stage of the proceedings (including after selecting the offer) without giving a reason. This announcement is solely a commercial information and does not constitute an offer within the meaning of the Civil Code. The sale is subject to a written offer competition combined with a second stage auction, which will take place only in the event of two or more offers with the same highest offered price. REGULATIONS OF THE TENDER § 1 Conditions of the tender 1. The bankruptcy trustee of Izabela Szpunar, a natural person not conducting business activity, sells as part of a free hand sale (in the form of a tender) a 1/3 share in the land property. The property is located in the Silesian Voivodeship, in the town of Bielsko-Biala, precinct 0007 Halcnów and consists of: four land plots with numbers: 2688/1, 2688/2, 2688/25, 3457/7. The subject property has a land and mortgage register number BB1B/00032955/9 maintained by the District Court in Bielsko-Biala, VII Land and Mortgage Register Department. 2. The minimum price of the tender is set at 13,810.08 PLN and constitutes 25% of the market value of the 1/3 share price specified in the valuation report. 3. The tender lasts until 02.09.2025. 4. A condition for participating in the tender is the payment of a deposit in the amount of 1,381.01 PLN (in words: one thousand three hundred eighty-one 01/100) to the bankruptcy estate account by 02.09.2025, with this day being the date of crediting the bank account. 5. The deposit must be credited to the bankruptcy estate account in BNP Paribas 14 1600 1462 1735 0799 0000 0001 before the opening of offers, under the penalty of non-recognition of the offer. 6. A condition for participating in the tender, besides the payment of the deposit, is to submit a written offer in the form of a letter sent by 03.09.2025 to the trustee's office address: ul. Michałowicza 12, 43-300 Bielsko-Biala (the date of receipt is decisive) along with a statement that the bidder: a. accepts the terms of Sale, which are the auction regulations b. has familiarized themselves with the factual and legal state of the subject of the tender and does not raise any objections and agrees to exclude liability for physical and legal defects under Article 558 1 of the Civil Code and stating the offered purchase price of the property. The envelope should be clearly marked - "Tender 1 - offer - case file BB1B/GUp-s/557/2023". 7. The deposit of the bidder whose offer is selected in the tender or auction mentioned below is non-refundable. It will be credited towards the purchase price. Other deposits will be returned within 3 days from the date of opening offers. 8. The opening of offers will be public on 03.09.2025 at 12:00 at the trustee's office at ul. Cieszyńska 365, room 203, Bielsko-Biala. A protocol will be drawn up from the opening. 9. In the event of two identical price offers, an oral auction will take place immediately after the opening of offers, with a bidding amount of 1,000 PLN. 10. Contact with the trustee through the data provided on the portal. § 2 Acquisition 1) The trustee will notify the bidder whose offer has been selected about the place and date of concluding the purchase agreement. 2) Before signing the agreement, the bidder is obliged to pay the remainder of the auctioned price within 60 days and to proceed to the notarial deed of sale no later than within the next 30 days from the date of payment of the remainder of the price under the penalty of forfeiture of the deposit in favor of the bankruptcy estate, provided that the bankruptcy estate bank account must be credited no later than the day before the established date of signing the final agreement. 3) The payment of the purchase price must be made by transfer directly from the bidder's bank account. 4) The sale conducted in bankruptcy proceedings has the effects of enforcement sale, in which encumbrances expire by operation of law under Article 313 of the Bankruptcy Law. 5) In the event of withdrawal by the winning bidder or failure to pay the remaining price within 60 days from selection, the trustee may conclude an agreement with the next bidder in line or repeat the tender. The decision belongs to the trustee, who will consider the interests of the bankruptcy estate, also taking into account the criterion of efficiency of the proceedings. 6) The costs of purchasing the property are borne by the Buyer. § 3 Final provisions In matters not regulated by these regulations, the provisions of the Civil Code with modifications resulting from the provisions of the Bankruptcy Law apply.
