THE STAROSTA OF ZAGAN ACTING ON BEHALF OF THE STATE TREASURY based on Article 38, paragraphs 1 and 2 of the Act on Real Estate Management of August 21, 1997 (Journal of Laws of 2024, item 1145, as amended) and the Act of April 11, 2003 on shaping the agricultural system (Journal of Laws of 2024, item 423, as amended). Announces the first limited oral auction for the sale of real estate owned by the State Treasury for individual farmers, as defined by the regulations on shaping the agricultural system intending to expand their family farm, provided they reside in the municipality where the property being auctioned is located or in a neighboring municipality. Plot number, area, location, and description of the property: Leszno Gorne district, Szprotawa municipality, plot number 27/14 with an area of 2.1640 ha, marked with the use PsVI, Lzr-PsV, Bp. The property is an undeveloped area, partially equipped with technical infrastructure - there is a water and telecommunications connection at the northern boundary. An energy network runs through the road strip. The property has a variable, uneven configuration, irregular, polygonal shape, elongated, covered with grassy vegetation and trees, predominantly birch species, partially coniferous species. In the northern part, there is a hardened strip of poured asphalt. The plot is contaminated by illegally accumulated waste and remnants of several large-format concrete slabs, fragments of demolished buildings, and cylindrical concrete shelters, not permanently connected to the ground. Three unused concrete power poles are placed on the ground. Direct access to the public road from the north, an asphalt-paved road - Fabryczna Street marked with plot number 412/3. A path driven by the vehicles of local residents runs through the middle of the plot. The surroundings consist of tanneries and multi-family residential buildings to the north, the Bóbr River, a small hydropower plant "MEW Leszno Gorne 3" and forest land to the west, and predominantly agricultural, forest land and a watercourse to the east and south. Purpose in the spatial development plan: There is no Local Spatial Development Plan, however, according to the "Study of Conditions and Directions of Spatial Development of the City and Municipality of Szprotawa" - adopted by the City Council in Szprotawa on July 26, 2024, resolution no. VI/30/2024, the area has the function of meadows and pastures. Starting price of the property/deposit: Starting price: 100,000.00 PLN plus VAT. Deposit: 10,000.00 PLN. Auction time: 9:00 AM. The first limited oral auction will take place on October 10, 2025, at the headquarters of the Starostwo Powiatowe in Zagan at ul. Jana Pawla II 9, room 104. The condition for participation in the auction is the payment of the deposit by October 1, 2025, and it must be in the account of the Starostwo Powiatowe in Zagan - PKO Bank Polski S.A. 96 1020 5402 0000 0602 0336 8206 by that date. The paid deposit is subject to: - inclusion in the purchase price of the property in case of winning the auction, - forfeiture in case of withdrawal by the participant who won the auction from concluding the contract, - return within 3 days after the closing, cancellation, invalidation, or negative result of the auction. The condition for qualification to participate in the auction is the submission at the headquarters of the Starostwo Powiatowe in Zagan of the specified documents and statements (confirming the fulfillment of the conditions for participation in the auction), in a sealed envelope, marked with the number of the property to which the submitted documents relate, in accordance with the content of this announcement (templates of statements are available from 7:30 AM to 3:00 PM at the Starostwo Powiatowe in Zagan, ul. Jana Pawla II 9, room 106, tel. 68 4775800). NOTE: submission of copies of statements certified by the mayor (mayor, city president) and a document confirming permanent residence is allowed. Therefore, no later than October 1, 2025, by 3:00 PM, the following documents must be submitted in a closed envelope marked "Qualification of participants for the auction for the sale of plot number 27/14 Leszno Gorne": - a statement from the individual intending to participate in the limited auction for the sale of the property, acknowledging familiarity with the subject of the auction, the content of the auction announcement, and the draft sales agreement, as well as meeting the conditions allowing participation in the auction (SAMPLE 1); - a statement on personally running an agricultural farm and the total area of agricultural land owned, used perpetually, in self-ownership, leased by an individual farmer (applies to all properties regardless of their location and number of farms) (SAMPLE 2). According to Article 7, paragraph 5a) of the Act, the person submitting the statement is obliged to include in it the clause of the following content: "I am aware of criminal liability for submitting a false statement." This clause replaces the authority's instruction on criminal liability for submitting a false statement; - a copy of the certificate (diploma) of completion of primary school or vocational school or secondary or higher education, a certificate with the title of qualified worker or a certificate with the vocational title or diploma with the title of master, issued by the state examination commission, or the chamber of crafts, a certificate confirming qualifications in the profession or a certificate of vocational qualifications issued by district examination boards or a certificate of completion of three levels of agricultural training, or a certificate of completion of three levels of agricultural training or a certificate of completion of agricultural training along with documents confirming work experience in agriculture (according to sample 3 point E if required), and in the case of a person who personally runs an agricultural farm for less than 5 years and on the date of the announcement of the list of properties intended for sale was no more than 40 years old - a statement certifying obtained agricultural qualifications (SAMPLE 3) along with copies of documents confirming their fulfillment; - a certificate from the relevant office confirming 5 years of continuous residence (containing the date of registration at the current address for permanent residence) - a certificate issued by the municipality is valid for 2 months from the date of issue. The 5-year residence period includes the period of residence in another municipality directly preceding the change of residence, if one of the agricultural properties belonging to the agricultural farm was located in that municipality. NOTE: Statements must be signed by hand. The Starosta of Zagan may notify law enforcement authorities of the submission of false statements. After reviewing the submitted documents, the list of persons qualified to participate in the auction, and the list of persons who did not submit all required documents necessary for qualification to participate in the auction on time will be posted on October 3, 2025, at the headquarters of the Starostwo Powiatowe in Zagan and published on the entity's website in the Public Information Bulletin under the auction announcement. At the same time, we inform that persons who are listed as those who did not submit all required documents necessary for qualification to participate - according to the documents provided on the list - have the opportunity to supplement them. To this end, no later than October 6, 2025, by 3:00 PM, they must submit the missing documents at the headquarters of the Starostwo Powiatowe in Zagan (in a sealed envelope marked with the number of the property to which the submitted documents relate and with the annotation SUPPLEMENT) for re-examination by the Commission. The list of all persons finally qualified to participate in the auction will be posted on October 9, 2025, at the headquarters of the Starostwo Powiatowe in Zagan and on the entity's website in the Public Information Bulletin under the auction announcement. Persons who do not submit the required documents by the above-mentioned dates and places will not be allowed to participate in the auction. The auction will also take place if only one person who meets the conditions specified in the announcement is qualified for the auction. The property is sold based on data from the land and buildings register in accordance with the extract from the land registry map. In the event of a possible boundary renewal carried out at the buyer's expense and effort, the Starosta of Zagan is not responsible for any discrepancies. A person participating in the auction must present an identity document, and a person representing an individual or legal entity at the auction must present the appropriate power of attorney with a notarized signature; spouses with statutory community property participate in the auction personally or by presenting the power of attorney of the spouse containing consent for the paid acquisition of the property. Entities that are foreigners must demonstrate the appropriate permit issued under the provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners (Journal of Laws 2017.2278, consolidated text). The auctioned price of the property is payable in such a way that the required amount is in the account of the Starostwo Powiatowe no later than the day before the conclusion of the notarial agreement. The costs associated with the preparation of the notarial agreement and court fees are borne by the buyer. Failure to meet the deadline for concluding the sales agreement results in the forfeiture of the deposit, and the auction is deemed null and void. The buyer will be notified of the date of concluding the sales agreement in the form of a notarial deed within 21 days from the date of the auction resolution.
