NOTICE OF THE FIRST AUCTION OF THE PROPERTY

The Court Bailiff at the District Court in Trzcianka, Bailiff's Office in Trzcianka, based on Article 953 of the Code of Civil Procedure, announces to the public that on 12-08-2025 at 10:30 in the building of the District Court in Trzcianka located at Staszica 1, 64-980 Trzcianka, the first auction of perpetual usufruct located at ul. Chopina, 64-980 Trzcianka will take place.

The estimated value is 467,116.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 350,337.00 PLN.

The bidder participating in the auction should submit a deposit in the amount of one-tenth of the estimated value, which is 46,711.60 PLN.

The deposit should be made in cash or to the Bailiff's bank account: Powszechna Kasa Oszczędności Bank Polski SA Branch 1 in Piła 90102038440000190200496752,

or in the form of a savings book equipped with the owner's authorization to withdraw the entire deposit according to the valid court decision on the loss of the deposit.

Description of the property:

The land is granted in perpetual usufruct and the building constitutes a separate property.

The property consists of land plots with registration numbers 1243/1, 1243/2, and 1243/3 with an area of 1425 m². In the land and mortgage register, the property is still registered as a plot with registration number 1243, as the division of this plot into plots with numbers 1243/1, 1243/2, and 1243/3 has not been disclosed. According to the local spatial development plan (Resolution of the City Council in Trzcianka No. XXXVII326/17 of 24.07.2017), plots No. 1243/1 and 1243/2 are marked as U7 service development areas, including trade services with the allowance of residential premises. Plot No. 1243/3 is marked as MWu2 - areas of multi-family residential development with services. The property is located in the city center at the intersection of Spokojna and Chopina streets and at the corner of the Post Office Square (marked in the land and mortgage register as ul. Chopina). The plots are equipped with electricity, water, sewage, and gas. Area of the plots: 1/plot No. 1243/1: 454 m², 2/plot No. 1243/2: 680 m², 3/plot No. 1243/3: 291 m². Plot No. 1243/3 is not built up. Plot No. 1243/1 is built with a three-story residential and service building. Plot No. 1243/2 is built with a single-story production building connected to the building located on plot No. 1243/1, creating one complex of buildings. Usable area of the buildings is 998.10 m², including the higher part - 670.50 m², lower part - 327.60 m².

According to Article 976 § 1 of the Code of Civil Procedure, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.

The property can be viewed two weeks before the auction from 11:00 to 11:30, after prior contact with the bailiff. The property valuation report along with the protocol of its description and valuation is available for inspection at the bailiff's office.

Rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from execution and have obtained a ruling suspending the execution in this regard.

Usufruct, easements, and rights of a life tenant, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of execution and will expire upon the finalization of the ruling on the awarding of ownership.
