NOTICE OF THE FIRST AUCTION OF REAL ESTATE

The Court Bailiff at the District Court in Zawiercie Marek Wojcik based on art. 953 of the Code of Civil Procedure announces to the public that:

in the building of the District Court in Zawiercie located at Leśna 4 in room No. 8, there will be

the first auction

of the ownership rights to the land of plots marked with numbers 1/11, 2/1, 2/4, 2/10, 2/11, 2/12, 2/13, 2/14, 2/15 covered by the land and mortgage register No. KW CZ1Z/000xxxxx/4 and plot No. 2/2 covered by the land and mortgage register No. KW CZ1Z/000xxxxx/0 km 19 District Zawiercie, with a total area of 5,250 m2,

built with a service building of a banquet hall with a lodging part with a usable area of 610.25 m2 and a single-family residential building with a usable area of 357.92 m2, located in Zawiercie, at Długa Street

The property is covered by land and mortgage registers No. KW CZ1Z/000xxxxx/4 and KW CZ1Z/000xxxxx/0 and constitutes a single economic whole functionally and installation-wise connected, therefore it should be sold in its entirety.

According to the local spatial development plan of the city of Zawiercie for the areas: Borowe Pole, Stawki, Blanowice, Kromołów, Zuzanka, Warty, Wydra Zielona, Łośnice, the property is located in the area marked with symbols: plots No. from 1/11 to 2/15 (front part of the property), 4U2 - areas of service building plots No. from 1/11, 2/2 and 2/4 (rear part of the property), 41MN4 - areas of single-family residential development, 102KDD - areas of communication roads of access class 56KDW - areas of communication of internal roads.

The property is encumbered with a limited property right. The indicated value is given without considering the easement.

The estimated value is 5,315,045.90 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 3,986,284.43 PLN.

The sale of the goods is subject to VAT at the rate of 23%. The above indicated amounts are gross amounts.

The VAT was determined from the part of the property intended for conducting business activities with a net value of 2,595,851.69 PLN, thus the value of VAT from this part amounts to 597,045.90 PLN. The net value of the entire property is 4,718,000.00 PLN.

The bidder participating in the auction is obliged, according to art. 962 § 1 to submit a deposit in the amount of one-tenth of the estimated value, which is 531,504.59 PLN (gross) no later than on the business day preceding the auction, that is on 09.10.2025 by transfer - to the account of the Court Bailiff: Powszechna Kasa Oszczędności Bank Polski SA 0. in Zawiercie 07 1020 2498 0000 8502 0125 3681, with the note Km 914/20, Km 748/19, ICo 803/19 - or in the form of a savings book equipped with the owner's authorization to withdraw the entire deposit according to the legally binding court decision.

According to the provisions of art. 976 §1 of the Code of Civil Procedure, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of the state authority, and those who have not presented this permission.

In the two weeks preceding the auction, it is allowed to view the property on weekdays from 10:00 to 12:00 and to review the protocol of the property valuation in the District Court in Zawiercie at Leśna 4, the expert's valuation report in case I Co 803/19. Those interested in viewing the property should report to the bailiff no later than two weeks before the auction to arrange a date for viewing the property.

The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations, if these persons do not submit proof before the start of the auction that they have filed a lawsuit to exempt the property or items seized with it from execution and have obtained a ruling suspending the execution in this regard. Use, easements, and rights of a lifetime, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the start of the auction, will not be taken into account in the further course of execution and will expire upon the finalization of the decision on the awarding of ownership. According to art. 18 of the Act on Goods and Services Tax (Journal of Laws No. 54, item 535), court bailiffs performing enforcement activities within the meaning of the provisions of the Code of Civil Procedure are taxpayers of the tax on the delivery made in the course of enforcement of goods owned by the debtor or held by him in violation of applicable regulations. According to art. 106 c point 2 of the Goods and Services Tax Act, invoices documenting the delivery of goods referred to in art. 18 of the cited act, for which the debtor is liable for tax, are issued on behalf of and for the debtor by court bailiffs performing enforcement activities within the meaning of the provisions of the Code of Civil Procedure.
