NOTICE OF SECOND AUCTION OF THE PROPERTY

The Court Bailiff at the District Court in Belchatow, bailiff's office number II in Belchatow, based on Article 953 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) announces to the public that in case Km 660/20 on 04-09-2025 at 08:50 in the building of the District Court in Belchatow located at Okrzei 4, 97-400, there will be the second auction:

- of the property located at ul. Lipowa, District 12, 97-400 Belchatow.

Property description:

Developed plot no: no 11/3 with an area of 1115m2 (the development consists of a single-story residential building with usable attic, basement, with a building area of 137 m2, usable area of 270m2 and a garage with a building area of 31m2 and usable area of 26m2), and developed plot no 11/4 with an area of 3066m2 (the development consists of a commercial and service building with a building area of 377m2, usable area of 704.42m2) located at: 97-400 Belchatow, Lipowa, District 12.

The estimated value is 1,466,000.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 977,333.33 PLN.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 146,600.00 PLN.

Within two weeks before the auction, it is allowed to view the above-mentioned property on weekdays from 11:00 AM to 12:00 PM. The protocol of description and valuation can be reviewed at the District Court in Belchatow ul. Okrzei 4, 97-400 Belchatow.

According to Article 962 kpc, the bidder participating in the auction should submit the deposit no later than the day before the auction.

The date of deposit submission is considered the day the bailiff's bank account is credited.

The deposit may also be submitted in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the court's valid decision on the loss of the deposit.

The presence of one bidder is sufficient for the auction to take place.

The rights of third parties will not be an obstacle to the auction and awarding ownership to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from execution and have obtained a ruling suspending the execution in this regard.

Usufruct, easements, and rights of a lifetime beneficiary, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction, will not be taken into account in the further course of execution and will expire upon the finalization of the decision on awarding ownership.

According to Article 976 § 1 kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, a bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
