NOTICE OF AUCTION OF A FRACTIONAL PART OF THE PROPERTY

The Court Bailiff at the District Court in Otwock Magdalena Grzędzielska, based on the provisions of Article 953 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) announces to the public that in case Km 943/22,

at the District Court in Otwock located at ul. Armii Krajowej 2, 05-400 Otwock in room No. 7, there will be

the second auction of a share amounting to 1/2 of the part

of the land property built with a residential house, located at: 05-420 Józefów, ul. Godebskiego, for which the IV Department of Land and Mortgage Registers of the District Court in Otwock maintains the land and mortgage register number WA1O/000xxxx/6 with an area of 1,438.00 m2.

The property constitutes a land plot with no. 210 precinct 0053. The plot has a residential building with a built-up area of 174 m2. The land plot no. 210 precinct 53 is a corner plot. The area of the plot is 1,438 m2. Land use: B - residential areas. The shape is similar to a parallelogram, flat terrain. The way the plot is developed and used: the plot is built with a residential building located in the southern part. In the remaining part, the plot is developed - an attractive home garden, ornamental vegetation, and tall greenery, driveway with Bauma paving. The property is fenced, on the street side with a brick fence, wooden panels, entrance gate with a wicket, garbage shed. Technical infrastructure connections have been brought to the building - electrical connection, gas, sewage, water from a drilled well, and a municipal water connection has been brought to the plot.

Description of the residential building. The building is 2-storey, with a basement. Built in the 90s of the last century, construction lasted until 2000. The shape is irregular, the building is 2-part, in the western part ground floor with usable attic, 2-car garage in the building structure. The building is brick, external plaster is cement-lime, beam-block ceilings, reinforced concrete stairs, wooden steps and railings, wooden roof truss covered with sheet metal, metalwork, wooden windows with double glazing, garage doors are tilting, wooden floors made of oak and pine boards, terracotta in the hall. In the sanitary rooms of the kitchen - tiles, terracotta, standard equipment. Electrical, water-sewage, gas installations, central heating from a gas boiler and a solid fuel boiler reserve. The built-up area is 174 m2 (based on the building registry), including based on cartometric measurement the western part 96 m2, the eastern part 78 m2. Usable area (based on data WiKp.3120.27902.1.2023) - 300 m2.

The estimated value of 1/2 of the property is 998,500.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 665,666.67 PLN.

In the last two weeks before the auction, the property can be viewed on weekdays from 8:00 AM to 6:00 PM. At the District Court in Otwock, the protocol of description and valuation can be reviewed (you must refer to the court case number: I Co 248/23).

According to Article 962 kpc, the bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 99,850.00 PLN, no later than the day before the auction. The deposit should be paid to the bailiff's bank account: Powszechna Kasa Oszczędności Bank Polski SA Branch 12 in Warsaw 95 10201127 0000 1702 0013 3751 The date of the deposit is considered the day the bailiff's bank account is credited. The deposit can also be made in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the court's valid decision on the loss of the deposit. The presence of one bidder is sufficient for the auction to take place.

Rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit evidence before the auction begins that they have filed a lawsuit to release the right of perpetual usufruct of the property or items occupied with it from enforcement and have obtained a judgment suspending enforcement in this regard.

Usufruct, easements, and rights of a life tenant, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership. According to Article 976 § 1 kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
