NOTICE OF THE FIRST AUCTION OF THE PROPERTY

The Court Bailiff at the District Court in Zywiec informs, based on Article 953 of the Code of Civil Procedure in connection with Article 955 of the Code of Civil Procedure, that on September 16, 2025, at 12:15 PM in room no. 46 of the District Court in Zywiec, the first auction of the property will take place in the form of: a land property built with a residential building with a usable area of 165.40 m2 (according to data from EGIB), located on plot no. 680/22, with an area of 0.0657 ha, located in Twardorzeczka at ul. Miodowa. The property is covered by the local spatial development plan. According to resolution no. L/359/18 of the Lipowa Commune Council of June 28, 2018, regarding the adoption of the change of the local spatial development plan of the Lipowa Commune - stage I, plot no. 680/22 is located in the area: D-49MN2 - Residential development areas with the possibility of services in the area of natural connections and in the buffer zone of the landscape park.

The property is valued at: 497,000.00 PLN.

The starting price in the above auction is: three-quarters of the valuation value, i.e. the amount: 372,750.00 PLN.

Participants in the auction are required to submit a deposit of 10% of the property valuation price, i.e. the amount of 49,700.00 PLN, no later than the day before the auction in cash or in the form of a savings book from banks authorized by banking law to issue it, equipped with the owner's authorization to withdraw the entire deposit according to the valid court decision or to the bailiff's account 18124048811111000053338332. The sale is not subject to VAT.

The property can be viewed within two weeks before the auction, the valuation report of this property is available for inspection at the bailiff's office. The protocol of description and valuation can be reviewed at the District Court in Zywiec during the above-mentioned period.

The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations, if these persons do not submit evidence that they have filed a lawsuit for exemption from the enforcement of this property or other items seized with it and have obtained a ruling suspending the enforcement in this regard before the auction begins. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the ruling on the awarding of ownership.

The buyer is obliged to pay the PCC tax in accordance with Article 1, paragraph 1, point 1, letter a of the Act of September 9, 2000, on the tax on civil law transactions and the fees resulting from Article 12, paragraph 4 of the Act of February 3, 1995, on the protection of agricultural and forest land (Journal of Laws 2015.909 j.t.).
