The Court Bailiff at the District Court in Piaseczno, based on Article 953 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) announces to the public that in the case AC KM 272/19 on 27-08-2025 at 08:15 in the building of the District Court in Piaseczno located at Kosciuszki 14, 05-500 Piaseczno, room 210, the second auction will take place: of the property located at Polna, 05-540 Ustanow. Description of the property: The land plot 160/4 from the precinct 0022 is located in the village of Ustanow, the Prażmów commune. The neighborhood consists of single-family buildings in free-standing development and undeveloped and forested plots. Access to the property is possible from the provincial road No. 873 in the village of Zalesie Gorne on Wiekowej Sosny Street, then Parkowa Street to Główna Street leading to Polna Street. The described plot occupies an area of 1000m2. On the plot, there is a single-family residential building in free-standing development, built in traditional masonry technology. The roof structure is wooden; the roof covering is sheet metal; windows are PVC; the facade is mineral plaster unpainted. In the land and building register, the building is not marked on the maps. The building was completed in 2007/2008. The building is planned on two levels. The living area with the main entrance from the east and a terrace from the west is located on the ground floor. An internal staircase connects the mentioned ground floor with the first floor of the building, where a large room above the garage, a laundry room, a corridor, two bedrooms, and a bathroom are planned. On the ground floor, in addition to the mentioned two-car garage, there is a boiler room, vestibule/hall, living room, dining room, kitchen, corridor, and WC. Some rooms with sloping ceilings below 1.90m may only be counted as auxiliary space. Usable area: 164.05 m2 + garage with boiler room in the building structure of 49.02 m2. The building is finished to a typical standard around 2008. Based on the entry in section III of the land and mortgage register No. XXX, a claim established in favor of XXX was determined in connection with the lease agreement dated 14-04-2011. Article 1002 kpc: upon the finalization of the decision on the transfer of ownership, the buyer enters into the rights and obligations of the debtor arising from the lease and rental relationship according to the provisions of law regulating these relationships in the event of the sale of the rented or leased property. If the lease or rental agreement for the property was concluded for a fixed term longer than two years, the buyer may terminate this agreement within one month from the finalization of the decision on the transfer of ownership, with a one-year notice period, unless the agreement provides for a shorter period, even if the agreement was concluded in writing and with a certain date, and the property was delivered to the tenant or lessee. The estimated value is 651,469.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 434,312.67 PLN. A bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 65,146.90 PLN. For two weeks before the auction, it is allowed to view the aforementioned property on weekdays from 10:00 AM to 3:00 PM. The protocol of description and valuation can be viewed at the District Court in Piaseczno, ul. Kosciuszki 14, 05-500 Piaseczno. According to Article 962 kpc, a bidder participating in the auction should submit a deposit no later than the day before the auction. The deposit should be submitted to the bailiff's account: PKO Branch 2 in Warsaw 24 1020 1026 0000 1802 0223 4599. The date of deposit submission is considered the day the bailiff's bank account is credited. The deposit may also be submitted in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the court's final decision on the loss of the deposit. The presence of one bidder is sufficient for the auction to take place. The rights of third parties will not hinder the auction and the transfer of ownership to the buyer without reservations if these persons do not submit evidence before the auction begins that they have filed a lawsuit to release the property or items seized with it from execution and obtained a judgment suspending the execution. Usufruct, easements, and lifetime rights, if not disclosed in the land register or by submitting a document to the document collection and not reported no later than three days before the auction begins, will not be taken into account in the further course of execution and will expire upon the finalization of the decision on the transfer of ownership. According to Article 976 § 1 kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
