NOTICE OF THE FIRST AUCTION OF THE PROPERTY

The Court Bailiff at the District Court in Ostroleka, based on Article 953 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) announces to the public that in the case Km 51/21 on 05-09-2025 at 10:30 in the building of the District Court in Ostroleka located at Mazowiecka 3, 07-410 Ostroleka, room VIII, the first auction will take place:

- of the property located in m. Przystan, 07-416 Ostroleka.

Description of the property:

The plot has an irregular polygon shape, built with two residential buildings and two utility buildings. The plot is fenced with a steel mesh, equipped with an electricity connection, its own water intake, and its own septic tank. The wooden residential building has a building area of 69m2, usable area of 54.70 m2, is single-story, not basement, built in 1939, covered with asbestos cement. The overall technical condition of the building is average, finishing standard is average. The second wooden residential building, covered with coated sheet metal, is single-story with a usable attic, with an added masonry part, has a building area of 95 m2, usable area of 114 m2, built in 2002. The utility building is wooden, made of logs with a building area of 31 m2, built in 1939, covered with asbestos cement, technical condition is poor. The masonry utility building, single-story, covered with asbestos cement, has a building area of 91 m2, built in 1960, technical condition is satisfactory.

The estimated total is 504,300.00 PLN, while the starting price is equal to 3/4 of the estimated total and amounts to 378,225.00 PLN.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated total, which is the amount of 50,430.00 PLN.

In the two weeks before the auction, the above-mentioned property can be viewed on weekdays from 08:00 to 15:00. The protocol of description and valuation can be reviewed at the District Court in Ostroleka ul. Mazowiecka 3, 07-410 Ostroleka.

According to Article 962 of the kpc, the bidder participating in the auction should submit the deposit no later than the day before the auction. The deposit can also be submitted in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the valid court decision on the loss of the deposit. The presence of one bidder is sufficient for the auction to take place.

The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the property or items seized with it from execution and have obtained a ruling suspending the execution in this regard.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of execution and will expire upon the finalization of the ruling on the awarding of ownership.

According to the provision of Article 976 § 1 of the kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
