NOTICE OF THE FIRST AUCTION OF REAL ESTATE
IN THE FORM OF ELECTRONIC AUCTION
Court Bailiff at the District Court in Szamotuly Rafal Nowak Deputy Michal Rojewski, Bailiff Office No. I in Miedzychod based on art. 986^ kpc announces to the public that

first auction of the property
consisting of undeveloped land, plot No. 1 (with an area of 29,600 m2 located in the town of Jasionna, Wronki commune along with its components in the form of forest, for which the District Court in Szamotuly keeps the land and mortgage register No. POI A/000xxxx/0.
According to the "Study of conditions and directions of spatial development of the City and Commune of Wronki", adopted by resolution No. Ll/430/2018 RMiG Wronki on 28.06.2018, the area of land plot No. 1 is: - agricultural land - symbol R (area of about: 1.5650 ha), - forest land - symbol ZL (area of about: 1.0118 ha), - area of multifunctional rural development - symbol RM (area of about: 0.3832 ha).
The sale of the property takes place through electronic auction via the IT system. The auction lasts 7 days and ends on 17.09.2025 at 10:00.
During the auction, bidders will offer the purchase price via the IT system. If a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes until bidding ceases. The bidder whose offer was the highest at the end of the auction wins.
After the auction, the bailiff will inform the bidders via the IT system about the selection of the bidder offering the highest price at the end of the auction.
The estimated value is 129,400.00 PLN, while the starting price is equal to three-quarters of the estimated value and amounts to 97,050.00 PLN.
A bidder participating in the auction, in accordance with the provisions of art. 962 kpc in conjunction with 986^ kpc should submit a deposit in the amount of one-tenth of the estimated value, which is 12,940.00 PLN (in words: twelve thousand nine hundred and forty zlotys 0/100), no later than two working days before the auction begins. The deposit should be paid to the bailiff's bank account: Cooperative Bank of the Międzychód-Sieraków Region at 50 90820005 0004 7835 2000 0010. The date of the deposit is considered the day the bailiff's bank account is credited.
The provisions of art. 964 do not apply. Along with the deposit, the bidder is obliged to provide in the IT system the data necessary to issue a decision on the award: PESEL number, identity document number, and a statement of whether they are married, and if so, whether the property is intended for joint or personal property, as well as to indicate whether they are bidding on their own behalf or as an attorney for another person, and any other data if required by separate laws.
The bailiff confirms the fact of submitting the deposit and providing the data mentioned in § 2 immediately after receiving them by allowing the bidder to participate in the auction. A refusal to allow participation in the auction will be communicated to the interested party via the IT system. The deposit submitted by the bidder who was awarded will be retained; the deposits of other bidders will be returned immediately. The condition for participation in the auction is the creation of an individual account in the IT system. The method of conducting the sale of real estate through electronic auction and the method of authenticating users of the IT system servicing the electronic auction of real estate is specified in the regulation of the Minister of Justice on the method of conducting the sale of real estate through electronic auction and the method of authenticating users of the IT system servicing the electronic auction dated 27-10-2021 (Journal of Laws of 2021, item 2005, as amended).
Debtors, bailiffs, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a public authority, and who have not presented this permission cannot participate in the auction. The power of attorney to participate in the auction must be confirmed by a document with an officially certified signature. Signatures on powers of attorney granted by state organizational units or local government organizational units and on powers of attorney granted to lawyers or legal advisors do not require certification.
According to art. 986^ § 4 point 4 kpc, in the two weeks prior to the auction, the property may be viewed at a time agreed in advance with the bailiff (no later than two weeks before the auction date).
The rights of third parties will not be an obstacle to the auction and awarding ownership to the buyer without reservations, if these persons do not submit proof before the auction begins that they have filed a lawsuit to release the property or items seized with it from enforcement and have obtained a judgment suspending enforcement; Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership. According to art. 4 of the Act on shaping the agricultural system of April 11, 2023 (Journal of Laws No. 64, item 592, as amended), if the acquisition of agricultural property occurs as a result of a court ruling, public administration authority, or a ruling of a court or enforcement authority issued based on the provisions on enforcement proceedings. The National Center acting on behalf of the State Treasury may submit a declaration of acquisition of this property upon payment of the price of this property. The provisions of art. 3 section 10 and 11 and the provisions of the Civil Code regarding the right of first refusal shall apply accordingly, with the notification being made by the court, public administration authority, or enforcement authority - in the case referred to in paragraph 1 point 3.
