NOTICE OF THE FIRST E-AUCTION OF REAL ESTATE
Court Bailiff at the District Court in Czestochowa Aneta Szczepanska, Bailiff Office No. XX in Czestochowa based on the provisions of Article 953 of the Code of Civil Procedure and 9864 of the Code of Civil Procedure announces to the public that:

The auction lasts 7 days from August 19, 2025, at 10:00 AM and ends on August 26, 2025, at 10:00 AM.
The estimated value is: 2,462,300.00 PLN
The starting price is equal to 3/4 of the estimated value and amounts to: 1,846,725.00 PLN
DEPOSIT amounts to: 246,230.00 PLN
The bidder participating in the auction should submit the deposit no later than 2 business days before the auction starts.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the information technology system servicing electronic auctions available at elicytacje.komornik.pl and joining the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.
Based on Article 986(4) § 2 of the Code of Civil Procedure, the condition for participation in the auction is the creation of an individual account in the information technology system.
Based on Article 986(7) § 3(1) of the Code of Civil Procedure, if a bid is submitted within 5 minutes before the planned end of the auction, this time is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until bidding ceases.
In the two weeks before the auction, the property can be viewed on weekdays from 8:00 AM to 3:00 PM. The power of attorney to participate in the auction should be confirmed by a document with an officially certified signature. In the information technology system (for authenticated users) along with the announcement of the auction, the protocol of description and valuation of the property is also made available.
The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to release the items from enforcement and have obtained a judgment suspending the enforcement.
Usufruct, easements, and lifetime rights, if not disclosed in the land register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.
According to Article 976 of the Code of Civil Procedure, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, a bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
After the auction is completed, the Court or court referendary issues a decision regarding the awarding at a non-public meeting within a week from the date of receiving the protocol from the course of the auction and the documents necessary for granting the award. The hearing of the bidder who offered the highest price and the auction participants is conducted only when necessary for issuing the decision regarding the awarding.
Upon the finalization of the decision on the awarding, the bailiff summons the bidder who obtained the award (the buyer) to pay the purchase price to the deposit account of the Minister of Finance within two weeks from the date of receiving the summons, deducting the deposit paid in cash. At the request of the buyer, the bailiff may set a longer deadline for payment of the purchase price, not exceeding one month. If the buyer does not fulfill the auction conditions regarding the payment of the price on time, they lose the deposit, and the effects of the award expire. The deposit lost by the buyer or collected from them covers the enforcement costs related to the sale, and the remainder is included in the amount obtained in enforcement or if the enforcement has been discontinued, is transferred to the income of the State Treasury. The buyer cannot demand the annulment of the purchase or a reduction in price due to defects in the property or items purchased with it. If the creditor's claim is paid along with the costs before the auction is closed, the bailiff will discontinue the enforcement.
