The bankruptcy trustee sells the ownership right to residential premises No. 7, with a usable area of 64.60 m² located in Kolobrzeg at ul. Lopuskiego 50A, for which the District Court in Kolobrzeg, V Land Registry Department, maintains the land and mortgage register No. KO1L/00038361/8, with a value for forced sale of 500,000.00 PLN (five hundred thousand zlotys), which is also the minimum amount. I. TERMS. Offers regarding the property should be submitted by bidders to the trustee's office at the address: ul. Tarnopolska 1a/9, 78-100 Kolobrzeg or send a scan of the signed offer to the email inbox, with the original offer to be delivered to the trustee's office no later than 3 (three) business days from the date of sending the offer. The consideration of offers will occur upon receipt. The criterion for selecting the offer will be the highest offered price. In the case of similar price offers, the trustee will order an auction, where it is reserved that the auction will not be conducted in the sense of the Civil Code. Subsequent consideration in the case of receipt of further offers will take place weekly depending on the influx of offers meeting the conditions contained in these regulations. Description and valuation are available at the trustee's office or via email. The property can only be viewed after prior arrangement of the date with the trustee. II. FORMAL REQUIREMENTS OF THE OFFER. Each offer should include: a) exact identification of the offeror - name and surname or company name and address of residence or registered office and contact details (phone number, email address), b) offered price (to be stated in figures and words) in Polish currency - in case of a discrepancy, the higher price prevails, c) proposed payment deadline - not longer than 30 days from the date of notification by the trustee about the approval of the offer, d) a statement from the offeror that they have familiarized themselves with the technical and legal condition of the subject of sale and that this condition raises no objections, e) a statement from the offeror that they have familiarized themselves with the sales regulations and do not raise objections to its terms. The trustee may require the submission of additional documents and statements with the offer or waive part of them. III. OTHER SALES CONDITIONS. The selection of the offer is made by the trustee after possibly conducting an auction. The trustee may postpone the auction to another date, of which they will inform the bidders. The trustee may not select any of the submitted offers. The buyer is obliged to pay the purchase price to the bank account indicated by the trustee. The trustee may require the buyer to pay a deposit of about 10% of the accepted purchase price within the time specified by them, from which the binding of the offer is dependent. The payment deadline is considered the date of receipt of funds in the trustee's account. Submission of an offer is simultaneously a declaration that the offeror agrees to the conditions specified in the regulations, including the exclusion of warranty for defects and limitation of the seller's liability for improper performance of the contract. Additionally, submission of the offer is tantamount to the offeror having fully familiarized themselves with the physical and legal condition of the subject of sale and not raising any comments. All costs of submitting the offer and concluding the sales contract are borne entirely by the buyer, in particular the costs of the notary and court. The seller does not provide any guarantees and excludes liability for warranty for defects in the property. The trustee is liable for improper performance of the contract only if the damage occurred due to their gross negligence and within the limits of actual damage. Liability for improper performance of the contract is completely excluded due to the technical condition of the property. It is presumed that the offeror participating in the competitive procedure is an entrepreneur. The entrepreneur cannot modify the provisions of these regulations. The date and place of concluding the contract is indicated by the trustee. The right to cancel the sales procedure at any stage in whole or in part or to withdraw without giving a reason is reserved.
