NOTICE OF THE FIRST AUCTION OF THE PROPERTY

The Court Bailiff at the District Court in Olsztyn Michal Napiorkowski based on Art. 953 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) announces publicly that in the case Km 240/22 on 14-07-2025 at 14:00 in the building of the District Court in Olsztyn located at Dąbrowszczaków 44, 10-900 Olsztyn, room 223, the first auction will take place:

- residential premises, located at ul. Dworcowa, 10-436 Olsztyn, for which the District Court in Olsztyn VI Division of Land and Mortgage Registers (address: ul. Dąbrowszczaków 44, Olsztyn, 10-543 Olsztyn) keeps the land and mortgage register with the number XXX.

The assessment amount is 266,000.00 PLN, while the starting price is equal to 3/4 of the assessment amount and is 199,500.00 PLN. The bidder participating in the auction should submit a deposit in the amount of one-tenth of the assessment amount, which is 26,600.00 PLN.

In the two weeks before the auction, it is allowed to view the property mentioned above on weekdays from 09:00 to 14:00. The protocol of description and assessment can be reviewed at the District Court in Olsztyn ul. Dąbrowszczaków 44, 10-900 Olsztyn.

According to Art. 962 kpc, the bidder participating in the auction should submit the deposit no later than the day before the auction.

The deposit should be submitted to the bailiff's account: BNP Paribas 37203000451110000004219230.

The date of the deposit submission is considered the day when the bailiff's bank account is credited.

The deposit can also be deposited in a savings book equipped with an authorization of the owner of the book for the withdrawal of the entire investment in accordance with the legally valid court decision on the loss of the deposit.

The presence of one bidder is sufficient for the auction to take place.

The rights of third parties will not hinder the auction and the adjudication of ownership to the buyer without reservations if these persons do not submit proof before the auction begins that they filed a lawsuit to release the property or items seized with it from enforcement and obtained a ruling to suspend enforcement.

Usufruct, easements, and lifelong rights, if not disclosed in the land and mortgage register or by submitting the document to the document collection and are not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire as of the moment of legal enforceability of the decision on adjudication of ownership.

According to the provisions of art. 976 § 1 kpc, the following cannot participate in the bidding: debtor, bailiff, their spouses, children, parents and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who may acquire the property only with the consent of the state authority, and have not presented this consent.
