NOTICE OF THE FIRST AUCTION OF REAL ESTATE
IN THE COURSE OF ELECTRONIC AUCTION
Judicial Officer at the District Court in Gorzow Wielkopolski Roksana Szuder-Gnarowska Judicial Office No. I in Gorzow Wielkopolski announces to the public that in case GKm 32/23 an auction will commence in the manner established in Article 986 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC)
the first auction in electronic mode
of the following properties: - property located at Szkolna/Lipowa, Stare Polichno, 66-431 Santok, for which the District Court in Gorzow Wlkp. VI Land and Mortgage Register Department (address: ul. Chopina 52/block 15, Gorzow Wielkopolski, 66-400 Gorzow Wielkopolski) maintains a land and mortgage register with the number GW1G/000xxxxx/3.
Description of the property: The subject of the auction is a land property located in Stare Polichno, ul. Szkolna/Lipowa (district 0009 Stare Polichno), municipality of Santok, Gorzow district, Lubusz Voivodeship. The property consists of:
a) an undeveloped plot of land No. 366/1 with an area of 0.03 ha (300 m2) - designated for use with the symbol Br-RVI, indicating in the land registry nomenclature as: built agricultural land
b) a developed plot of land No. 367 with an area of 0.26 ha (2600 m2) - designated for use with the symbol Br-RVI, indicating in the land registry nomenclature as: built agricultural land.
The development consists of:
-a non-residential building, classified according to KŚT as: industrial building, non-residential building, classified according to KŚT as: other non-residential buildings, non-residential building, classified according to KŚT as: other non-residential buildings
– these buildings are directly adjacent to each other, connected by internal passages and essentially form one functional and economic whole with a total building area of 1369.00 m2 and a total usable area of 1252.60 m2.
-a steel shelter with a measured area of 137.00 m2, located on the site of a former residential building
Additionally, according to the land registry map, on the subject plot of land is a non-residential building with a building area of 24 m2. In practice, this object constitutes a brick annex to the village hall (municipal facility) and actually constitutes its functional part. This state is not legally sanctioned c) a developed plot of land No. 374/1 with an area of 0.27 ha (2700 m2) - designated for use with the symbol Br-RVI, indicating in the land registry nomenclature as: built agricultural land, and with the symbol RVI, indicating: arable land. The development consists of: -a non-residential building, classified according to KŚT as: service and agricultural production buildings and another non-residential building, also classified according to KŚT as: service and agricultural production buildings – these buildings are directly adjacent to each other, connected by internal passages and essentially form one functional and economic whole with a total building area of 610.00 m2 and a total usable area (including the attic) of 783.00 m2 -a small, brick non-residential building (former transformer station), attached by the rear wall to the above-described object, classified according to KŚT as: service and agricultural production buildings with a building area of 7.00 m2 and a usable area of 5.50 m3 -recorded in part brick shelter with a currently measured area of 216.00 m2
Additionally, according to the land registry map, on the subject plot of land, behind the rear wall of the above-mentioned brick shelter, is a non-residential building with a building area, according to the building records, of 20 m2. In practice, this object, as a wooden shed and the area around this building, belonging to the estimated property, has been used for a very long time by the owner of the neighboring plot No. 374/2, who has also fenced off this area from the entire estimated plot. This state is not legally sanctioned.
The subject plots are located in one area, situated in direct proximity, previously formed, along with other neighboring plots, a functional and economic whole of a former fruit and vegetable processing enterprise. Currently, the property has been unused for about 10 years, the entire area is neglected, overgrown with wild vegetation, the buildings are not being maintained or heated in any way, visible damage to the objects is slowly but systematically deteriorating.
The total valuation is 855,000.00 PLN, while the starting price is equal to 3/4 of the valuation and amounts to 641,250.00 PLN.
Within two weeks before the auction, the above-mentioned property can be viewed on weekdays from 09:00 to 13:00. The protocol of description and valuation is made available in the IT system.
The bidder participating in the auction should submit a deposit of one-tenth of the valuation amount, which is 85,500.00 PLN. The deposit must be submitted to the judicial officer's bank account 26 1020 1967 0000 8102 0038 1350 no later than 2 working days before the auction begins.
The auction takes place in the course of the sale of real estate by electronic auction and will start on: 02.10.2025 at 11:00 and will end on: 09.10.2025 at 11:00.
Based on Article 986 § 3 CPC, if within 5 minutes before the planned end of the auction a bid is submitted, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease. The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at the address elicytacje.komornik.pl and joining the auction two working days before it starts. The bidder submits the deposit no later than 2 working days before the auction begins, and if participating in the auction as a proxy for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.
Based on Article 986 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system. The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit proof before the auction begins that they have filed a lawsuit for the release of the items from enforcement and obtained a judgment suspending the enforcement in this regard. Use, servitudes, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.
