Court bailiff at the District Court in Gdynia, Katarzyna Lniska Bailiff's Office, Silesian 51/30, 81-304 Gdynia Signature: Km 883/22 NOTICE OF FIRST AUCTION OF REAL ESTATE BY ELECTRONIC AUCTION Court bailiff at the District Court in Gdynia, Katarzyna Lniska, Bailiff's Office No. XVII in Gdynia announces to the public that in case Km 883/22 on the day: 18.09.2025 at 12:30, the first auction will begin in the manner established in Article 9864 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC) in electronic mode for the following real estate: - residential premises located at Ujejskiego 38A/4, 81-426 Gdynia, for which the District Court in Gdynia, V Land and Mortgage Register Department maintains the land and mortgage register. Description of the property: The property - a unit constituting a separate property, a residential unit, with an area of 36.38 m², consisting of 2 rooms, located on the second floor, the share associated with the ownership of the unit is 422/10000. The estimated value is 359,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 269,250.00 PLN. For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 15:30 to 16:00. The protocol of description and valuation is made available in the IT system. The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 35,900.00 PLN. The deposit must be paid to the bailiff's bank account no later than 2 business days before the auction begins. The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions and joining the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction begins, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place. According to Article 9864 § 2 CPC, a condition for participation in the auction is the creation of an individual account in the IT system. The auctions of the above-mentioned properties will take place electronically and will end on: 25.09.2025 at 12:30. According to Article 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes until the bids cease. The rights of third parties will not hinder the auction and the award to the buyer without reservations, if these persons do not submit proof before the auction begins that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending the enforcement in this regard. Usufruct, easements, and rights of a life tenant, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership. According to Article 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
