ANNOUNCEMENT OF AUCTION Based on Article 38 and Article 40 paragraph 1 point 1 of the Act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145 with subsequent amendments) and § 13 and § 14 of the Regulation of the Council of Ministers of September 14, 2004 on the method and procedure for conducting auctions and negotiations for the sale of real estate (Journal of Laws of 2014, item 1490 with amendments), the Mayor of the Milicz Commune announces the first public oral auction without restrictions for the sale of undeveloped land located in Kaszowo, owned by the Milicz Commune, land register number WR1M/00029717/0, marked in the land registry as plot number 124/1 AM 1 with a total area of 1.2619 ha in the Kaszowo precinct. Starting price - 451,000.00 PLN + 23% VAT Deposit - 30,000 PLN The amount of the bid increase is determined by the auction participants, provided that the increase cannot be less than 1% of the starting price, rounded up to the nearest ten PLN. According to the local spatial development plan, the plot is located in the area of tourist services, sports, and recreation (UT.4). The property is in the zone of protection of archaeological monuments "OW". The sale is based on data from the land registry. The buyer takes over the property in its existing state. The property is overgrown with weeds with minimal shrub and tree cover. Within the plot, there is an electricity and water network, connected from the northwestern side to an unarranged road. Along the southern boundary of the property runs a water ditch. The property is free of encumbrances. The auction will take place on September 17, 2025, at 12:00 in Room 45 of the Milicz City Hall, ul. Trzebnicka 2. The condition for participating in the auction is the payment of a deposit in cash (indicating the plot number) transferred to the account of the Milicz City Hall in the Cooperative Bank in Milicz account number 72 9582 0000 2000 0000 0358 0004 by September 11, 2025. The date of deposit payment is considered the date of receipt of funds in the account of the Milicz City Hall. Auction participants are required to have an identity document, proof of deposit payment, and companies and partnerships additionally an up-to-date excerpt from the KRS or a certificate of conducting business activity. Participants may take part in the auction personally or through a proxy (notarial power of attorney). The deposit will be returned immediately after the cancellation or closure of the auction. The deposit paid by the person who wins the auction will be credited towards the purchase price. If the person designated as the buyer does not appear without justification at the place and time set by the auction organizer for the conclusion of the contract, the auction organizer may withdraw from the conclusion of the contract, and the paid deposit is non-refundable, and the auction is rendered void. The price achieved in the auction, along with VAT, constitutes the purchase price, payable in a lump sum no later than the day of the notarial contract. The date and place of the sale agreement (signing of the notarial deed) will be determined by the auction organizer after the auction, no later than 21 days from the date of the auction. Foreigners (within the meaning of the Act of March 24, 1920 on the acquisition of real estate by foreigners - Journal of Laws of 2017, item 2278) in the event of winning the auction are required to obtain the consent of the Minister of Internal Affairs for the acquisition of real estate in cases where such consent is required before concluding the notarial contract. The auction may be canceled or invalidated only for important reasons. The buyer bears the costs of notarial and court fees. The announcement of the auction is posted on the notice board at the seat of the local office, on the websites, and on the notice board of the Kaszowo village.
