ANNOUNCEMENT OF AUCTION Based on Article 38 and Article 40 paragraph 1 point 1 of the Act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145 as amended) and § 13 and § 14 of the Regulation of the Council of Ministers of September 14, 2004 on the method and procedure for conducting auctions and negotiations for the sale of real estate (Journal of Laws of 2014, item 1490 as amended), the Mayor of the Milicz Commune announces the first public oral auction without restrictions for the sale of undeveloped land located in Milicz, owned by the Milicz Commune, land register number WR1M/00028732/4, marked in the land registry as plot 7/3 AM 29 with a total area of 0.5399 ha in the Milicz district. Starting price - 616,000.00 PLN + 23% VAT Deposit - 50,000 PLN The amount of the bid is determined by the auction participants, provided that the bid cannot be less than 1% of the starting price, rounded up to the nearest ten PLN. According to the local spatial development plan, the property is marked with the symbol MN0.4 - primary purpose - single-family residential development and supplementary purpose: accompanying services, with the possibility of locating them independently except for terraced development, their share in the building area cannot exceed 30%, excluding nuisance activities, accompanying facilities, services related to the repair and servicing of cars and motorcycles; ZP13 - areas of arranged greenery - parks. The property is located in the zone of protection of archaeological monuments "OW". Undeveloped plot. An overhead medium voltage power line runs through the plot with a concrete pole. In the event of any project collisions, the buyer will relocate the line at their own expense, after making the legally required arrangements and obtaining permits. The condition for participating in the auction is the payment of a deposit in cash (indicating the plot number) transferred to the account of the Milicz City Hall in the Cooperative Bank in Milicz account number 72 9582 0000 2000 0000 0358 0004 by September 11, 2025. The date of the deposit is considered the date of receipt of funds in the account of the Milicz City Hall. Auction participants are required to have an identity document, confirmation of deposit payment, and companies and partnerships additionally a current excerpt from the KRS or a certificate of conducting business activity. Participants may take part in the auction in person or through a proxy (notarial power of attorney). The deposit will be returned immediately after the cancellation or closure of the auction. The deposit paid by the person who wins the auction will be credited towards the purchase price. If the person designated as the buyer does not appear without justification at the place and time set by the auction organizer for the conclusion of the contract, the auction organizer may withdraw from the conclusion of the contract, the paid deposit is non-refundable, and the auction is deemed invalid. The price achieved in the auction, along with VAT, constitutes the purchase price, payable in a lump sum no later than the date of the notarial contract. The date and place of the sale agreement (signing of the notarial deed) will be determined by the auction organizer after the auction, no later than 21 days from the date of the auction. Foreigners (within the meaning of the Act of March 24, 1920, on the acquisition of real estate by foreigners - Journal of Laws of 2017, item 2278) in the event of winning the auction are required to obtain the consent of the Minister of Internal Affairs for the acquisition of real estate in cases where such consent is required before concluding the notarial contract. The auction may be canceled or invalidated only for important reasons. The buyer bears the costs of notarial and court fees.
