According to Article 39 of the Real Estate Management Act (Journal of Laws of 2023, item 344 as amended), I announce the third unlimited oral auction for the sale of real estate owned by the municipality of Orzysz located within the city of Orzysz. 1. The subject of sale is undeveloped land marked with geodetic number 59/10 with an area of 0.3845 ha located in the geodetic area of Cierzpiety, Orzysz municipality. 2. In the local spatial development plan of the Cierzpiety area, the plot is marked with the symbols: ZS - green areas related to sports, tourism, and recreation, and KW - internal road areas. 3. The property has been included in the list no. WIG.6840.19.2023.KOW dated June 12, 2024, made public on June 12, 2024. 4. The first unlimited oral auction scheduled for October 1, 2024, announced by auction no. WIG.6840.19.2023.KOW dated July 29, 2024, made public on July 29, 2024, ended with a negative result, no one paid the deposit and no one participated in the auction. 5. The second unlimited oral auction scheduled for October 1, 2024, announced by auction no. The sale will take place with the conclusion of a conditional notarial deed, as the State Treasury, represented by the State Forests, has a legal right of pre-emption for this land. 9. The starting price of the property: 790,000.00 PLN gross. 10. The auction will take place on July 22, 2025, at 12:00 in the City Hall in Orzysz, room no. 113 (meeting room). 11. Deposit: 79,000.00 PLN. 12. The condition for participating in the auction is to pay the deposit to the account of the City Hall in Orzysz Warmińsko Mazurski Cooperative Bank Branch in Orzysz account no. 02 9364 0000 2003 0001 9817 0007. The candidate for the buyer of the above property is the person who offered the highest price. 15. The deposit of the participant who wins the auction will be credited towards the purchase of the property. 16. The deposits of other participants will be returned within 3 days from the date of closing or canceling the auction. 17. In case of withdrawal by the participant who won the auction from concluding the sale agreement within the time specified in the notification, the deposit will be forfeited to the Municipality of Orzysz. 18. The auction organizer will notify the participant who won the auction about the place and date of the notarial deed of the sale agreement within 21 days from the date of the auction resolution. 19. The buyer should pay the auction price before concluding the notarial deed to the account specified in the auction protocol no later than the day before signing the notarial deed. 20. The costs of the notarial deed are borne by the buyer. 21. The demarcation of the property boundaries will be carried out at the buyer's expense and effort. 22. The auction will end with a negative result if none of the auction participants offers a price higher by at least one bid from the starting price stated in the announcement. 23.
