ANNOUNCEMENT OF AUCTION The Mayor of the City of Swidnik announces the first unrestricted oral auction for the sale of the following undeveloped properties marked as: 1. Plot No. 1335/6 with an area of 1772 m2, located in Swidnik at Al. NSZZ "Solidarity", precinct 0001 - City of Swidnik, for which land register No. LU1I/00102528/0 is maintained. 2. Plot No. 1333/19 with an area of 547 m2, located in Swidnik, precinct 0001 - City of Swidnik, for which land register No. LU1I/00150227/1 is maintained. The above-described properties are located in an area designated for single-family residential or service development (symbol 2MN-U) in the local spatial development plan. Part of plot No. 1335/6 is fenced and has a gazebo with plantings. The neighborhood consists of single-family residential areas. The area where the properties are located has technical infrastructure in the form of networks: electrical, gas, water supply, sanitary sewage, and telephone. Access to the property is via an asphalt road. The fenced part of plot No. 1335/6 has been leased according to an agreement for a specified time until December 31, 2025. Sections III and IV of land register No. LU1I/00102528/0 maintained for plot No. 1335/6 do not contain entries. Section III and IV of land register No. LU1I/00069372/7 maintained for plot No. 1333/19 do not contain entries. The deadline for submitting applications by persons entitled to priority in acquiring the property under Article 34, paragraph 1, points 1 and 2 of the Real Estate Management Act expired on July 9, 2025. Starting price in total: 1,400,000.00 PLN (in words: one million four hundred thousand, 00/100) The amount of the deposit is 10% of the starting price. The deposit in the specified amount must be paid in cash by transfer to the account of the City of Swidnik No. 02 1020 3176 0000 5202 0013 8495 by September 17, 2025. The date of payment of the deposit is considered the date of receipt of the money in the deposit account of the City of Swidnik. The first unrestricted oral auction will take place at the City Hall of Swidnik at Stanislaw Wyspianski Street 27 in Swidnik on September 23, 2025, at 1:00 PM in the plenary hall No. 016 (on the ground floor). Additional information: 1. The deposit paid by the participant who wins the auction will be credited towards the purchase price of the property on the day of payment of the remaining part of the sale price, 2. The remaining participants will have their deposits returned within 3 days from the closing of the auction to the account they indicate, 3. The person designated as the buyer of the property will be notified of the place and date of the notarial sale agreement no later than 21 days from the date of the auction decision. The designated date cannot be shorter than 7 days from the date of delivery of the notification, 4. If the buyer of the property does not appear without justification at the place and time specified in the notification, the auction organizer may withdraw from concluding the agreement, and the paid deposit will not be refunded, 5. All costs related to the conclusion of the notarial sale agreement and court fees shall be borne by the buyer of the property, 6. Foreigners may acquire property in accordance with the applicable provisions of the Act on the Acquisition of Real Estate by Foreigners, 7. Individuals and legal entities who pay the deposit within the time specified in this announcement may participate in the auction, 8. Auction participants are required to present to the Auction Committee before the auction starts: a) identity document, b) a written statement of having read the auction conditions specified in the announcement and the auction regulations and accepting them without reservations, c) a written statement that the auction participant has familiarized themselves with the documentation of the property being sold, its factual and legal status. d) legal entities must provide documents confirming the legal status of the auction participant and the manner of representation, e) Participants taking part in the auction through a proxy are required to present documents proving, in accordance with applicable regulations, the representation of the person or organizational unit participating in the auction, f) bank account number to which the deposit will be returned in case of not winning the auction, g) written consent of the spouse for the paid acquisition of the property, in the case of an auction participant intending to bid alone for property to be acquired into joint property, 9. The price for the property achieved in the auction will be payable in full no later than on the day of concluding the notarial agreement, where the date of confirmation of payment is considered the day of receipt of the money in the bank account of the City of Swidnik, 10. The sale price will be subject to VAT in accordance with the applicable provisions on the day of sale, payable within the above-mentioned deadline, 11.
