Terms of sale with free hand under the proceedings number I

I). Subject of sale: Cooperative ownership right to residential premises No. 4, located at Pogodna 29 in Kudowa-Zdroj, on plot No. 189/4 district 0008, located on the first floor (2 storeys), with usable area of 65.30 m2. The premises includes a cellar with an area of 6.68 m2. No land and mortgage register is maintained for the residential property. For the land, the District Court in Swidnica, V Department of Land and Mortgage Registers maintains KW No. SW1K/00040953/6.

II). Identification of the bankrupt: Nikolay Ivanov, residing at 57-350 Kudowa-Zdroj, Pogodna 29/4.

III). Identification of the Court and case number: District Court in Walbrzych, VI Economic Department, Słowackiego 10, 58-300 Walbrzych, Case No. SW1W/GUp-s/204/2024.

IV). Basis for disposal: Article 491(11a) paragraph 2 of the Bankruptcy Law of February 28, 2003 (Dz.U.2024.794 t.j.).

1). The sale occurs under free hand, in a public offer.

2). The sale may take place at the highest price achievable on the market, but no lower than 444,000.00 PLN.

3). The procedure for sale under free hand is written, offer-based – subject to point 17 of these terms of proceedings.

4). The offer with the highest proposed sale price binds the offeror and constitutes the most advantageous offer in the course of the offer proceedings for the sale of the subject of the proceedings – until the possible auction is resolved, referred to in point 17 of these terms of proceedings.

5). The participant in the proceedings should, under the risk of exclusion from participation in it, pay a deposit to the bank account of the bankruptcy estate (account number: 25 1020 5242 0000 2802 0658 0296) by July 8, 2025 in the amount of 44,400.00 PLN.

6). The deposit paid by the offeror whose offer has been chosen will be credited to the purchase price, and in the event of failure to conclude the sales contract within two months from the date of approval of the selection of the offer by the Commissioner Judge due to the fault of the offeror, the deposit will be forfeited to the bankruptcy estate. Other offerors' deposits will be refunded within 14 working days from the approval of the offer.

7). The offeror whose offer has been selected is obliged to conclude the sales contract within two months from the date of approval of the selection of the offer by the Commissioner Judge and by the date of concluding the contract must pay the entire offered price.

8). The costs of checking the sale subject and concluding the contract shall be borne by the buyer.

9). The buyer agrees to exclude liability for physical and legal defects of the sale subject.

10). The terms of the sales agreement established by the trustee are not subject to negotiation; the trustee has the right to choose the notary before whom the activities related to the sale will be performed.

11). The offer must include:

  • identification of the offeror, proposed purchase price of the property, signature of the offeror or a person authorized by the offeror acting on their behalf, contact phone number,
  • original or photocopy of the certificate of entry in the appropriate register of entrepreneurs or a notarized photocopy of the identity card if the offeror is a natural person,
  • if the offeror is an entrepreneur - original or photocopy of a decision of the appropriate Tax Office granting the tax identification number (NIP) in case the NIP number is not disclosed in the certificate of entry in the appropriate register of entrepreneurs,
  • if the offeror is an entrepreneur - original or photocopy of the certificate of the identification number REGON issued by the appropriate Statistical Office in case the REGON number is not disclosed in the certificate of entry in the appropriate register of entrepreneurs,
  • original of any granted power of attorney or its photocopy confirmed for compliance with the original by a notary,
  • statement of consent to cover all costs associated with the transfer of ownership,
  • statement of familiarization with the state of the auction subject including legal and technical conditions and a statement of consent to exclude liability for physical defects based on Article 558 of the Civil Code,
  • agreement or promise of agreement from the Minister of Internal Affairs for the purchase of the sale subject in the case of an offeror from outside the European Economic Area and the Swiss Confederation,
  • confirmation of deposit payment

12). An offer that does not contain at least one of the above will not be considered.

13). The submission of one offer is sufficient for the sale to occur.

14). Offers in Polish or translated into Polish by a sworn translator in sealed envelopes preventing their opening with clear and legible identification of the offeror, and with the notation "Proceedings for sale - SW1W/GUp-s/204/2024 - DO NOT OPEN" must be received by July 8, 2025 at the address: Office of the Trustee, Judicial Supervisor, Manager Dr. Michal Blaszczyszyn, PO Box 102, 53-350 Wroclaw 15. The date of receipt counts.

15). The opening of offers will take place on July 10, 2025, at 12:00, the place of opening offers: Office of the Trustee in the presence of all interested parties.

16). The opening of offers will be evaluated in terms of compliance with the conditions of the offer procedure, which are specified above, and the proposed purchase prices.

17). In the case of equal offers, an oral auction may be held on July 10, 2025, at 12:30, place of the auction: Office of the Trustee with the following:

  • participants in the auction will be admitted, who submitted equal highest offers; by which are understood those in which the offered sale price differs by no more than 1% of the minimum price specified according to point 2, rounding up to full hundreds of PLN,
  • bidding in the auction will be set at 100.00 PLN net.
  • the starting price is the highest price indicated in the offer,

18). The selection of the most advantageous offer will be made by the Trustee, the selection requires the approval of the Commissioner Judge.

19). The price must be paid no later than at the time of concluding the contract - before its conclusion.

20). In matters not regulated by these terms, the provisions of the Bankruptcy Law and the provisions of the Civil Code shall apply accordingly.

21). The possibility of canceling in whole or in part the sale proceedings or invalidating it at any stage of the proceedings without giving reason is reserved.
