ANNOUNCEMENT Mayor of the City and Commune of Lesko The Mayor of the City and Commune of Lesko, in accordance with Article 37(1), Article 38, Article 40(1), (2) and (3) of the Act of August 21, 1997 on Real Estate Management (consolidated text Journal of Laws of 2024, item 1145, as amended), and the Regulation of the Council of Ministers of September 14, 2004 on the method and procedure for conducting auctions and negotiations for the sale of real estate (Journal of Laws of 2021, item 2213) announces the second unlimited oral auction for the sale of undeveloped property located in Lesko, owned by the municipal property of the Commune of Lesko. The first auction took place on June 16, 2025, and was not resolved. 2. The condition for participation in the second auction is the payment of the deposit. The deposit must be paid in PLN to the bank account of the Commune of Lesko no. 97 1130 1105 0005 2072 7320 0006 maintained by BGK, exclusively by transfer, in such a way that by September 1, 2025, the deposit is in the bank account of the Commune of Lesko. The date of the deposit payment is the date of crediting the bank account of the Commune of Lesko. 3. The deposit of the winning participant is credited towards the purchase price of the property. The remaining participants will have their deposits returned promptly, within 3 days, from the cancellation, closure, invalidation, or negative result of the auction, in a manner corresponding to the form of payment. 4. The deposit is forfeited if the person who won the auction does not appear to conclude the notarial deed at the designated place and time or does not present proof of payment of the price determined in the auction, reduced by the paid deposit. 5. The auction is valid regardless of the number of participants if at least one participant has offered at least one bid above the starting price. The amount of the bid is determined by the auction participants, provided that the bid cannot be less than 1% of the starting price, rounded up to the nearest tens of zlotys. 6. The auction committee confirms the payment of the deposit by the auction participants before the auction opens. Before the auction opens, its participant must present proof of identity to the auction committee. 7. The seller will notify the winning bidder of the place and time of the notarial deed conclusion 7 days before its conclusion. The notarial deed will be drawn up no later than 21 days from the signing of the auction protocol. The buyer is obliged to pay the entire purchase price of the property to the seller's account before the designated date of the notarial deed conclusion - the property sale agreement. On the day of signing the notarial deed, the financial resources should be in the bank account of the Commune of Lesko. Notarial and court fees related to the conclusion of the notarial deed are borne by the buyer. 8. Failure to conclude the notarial deed will result in the forfeiture of the paid deposit. 9. The right to cancel or invalidate the auction for important reasons is reserved, stating the reason for the cancellation or invalidation of the auction to the public. 10. A foreigner, within the meaning of the provisions of the Act of March 24, 1920 on the acquisition of real estate by foreigners (consolidated text Journal of Laws of 2017, item 2278) participating in the auction procedure is obliged to present the auction committee with permission (or promise) from the Minister of the Interior for the acquisition of real estate if obtaining permission results from the provisions of the cited law. 11. Participation in the auction procedure is associated with the processing of personal data of bidders under the principles set out in the Regulation of the European Parliament and Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Journal of Laws of the EU L 119 of 05.04.2016). 12. In the event of changes regarding the conditions of participation in the auction, information in this regard will be published on the website of the Public Information Bulletin of the City and Commune Office of Lesko, where the auction announcement is located. The content of the announcement will also be published on the notice board of the Office and in the daily press of nationwide reach - the Official Monitor. 13.
