Court Bailiff at the District Court in Zabkowice Slaskie Henryk Kupis Bailiff's Office, 1 Maja 8F, Zabkowice Slaskie, 57-200 Zabkowice Slaskie Signature: GKm 16/22 NOTICE OF FIRST AUCTION OF REAL ESTATE The Court Bailiff at the District Court in Zabkowice Slaskie, based on Article 953 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC), announces to the public that in case GKm 16/22 on the day 11-09-2025 at 10:15 in the building of the District Court in Zabkowice Slaskie located at 1 Swierkowa St., 57-200, room 24, there will be the first auction: - of the property located in Sulislawice, 57-200 Zabkowice Slaskie, for which the District Court in Zabkowice Slaskie, 5th Land Registry Department (address: 1 Swierkowa St., Zabkowice Slaskie, 57-200 Zabkowice Slaskie) maintains a land register with the number SW1Z/000XXXXX/4. Property description: the property is located on plots no. 95, 53, 299, 51/1, 285/3 with a total area of 4.05 ha. These plots are located in various parts of Sulislawice. The property on plot no. 95 with an area of 1.23 ha is built with a production-residential building (former bakery) and a utility building (former sheepfold), while the remaining part of the land is used for agricultural purposes. Plot no. 299 with an area of 0.15 ha is classified as pasture class V, plot no. 285/3 with an area of 0.22 ha is agricultural land - RIIIa and is used agriculturally, plot no. 53 with an area of 1.43 ha consists of meadows class IV, pasture class V, and forest, plot no. 51/1 with an area of 1.02 ha is a meadow class IV and pasture class V. For the area where the property is located, there is a valid Local Spatial Development Plan for the village of Sulislawice in the municipality of Zabkowice Sl. (Resolution No. XLII/10/2013 of the City Council of Zabkowice Sl. dated 28-02-2013). In this document: - plot no. 51/1 is marked with the symbol R2.17 - agricultural areas, - plot no. 53 is marked with the symbol R2.17 - agricultural areas and in part ZL8 - forest areas, - plot no. 95 is marked with the symbol RM3 - areas of farm buildings, MU19 - areas of residential and service-economic buildings and in a small part KD D3 - public road areas (D: access), - plot no. 285/3 is marked with the symbol R2.17 - agricultural areas, - plot no. 299 is marked with the symbol R2.13 - agricultural areas. The total valuation is 672,900.00 PLN, while the starting price is equal to 3/4 of the valuation and amounts to 504,675.00 PLN. The bidder participating in the auction should submit a deposit of one-tenth of the valuation, which is the amount of 67,290.00 PLN. For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 08:00 to 10:00. The protocol of description and valuation can be reviewed at the District Court in Zabkowice Slaskie at 1 Swierkowa St., 57-200 Zabkowice Sl. According to Article 962 of the CPC, the bidder participating in the auction should submit the deposit no later than the day before the auction. The deposit should be submitted to the bailiff's account: Santander Bank Polska SA 72 1090 2372 0000 0006 0400 4445. The date of deposit submission is considered the day the bailiff's bank account is credited. The deposit may also be submitted in a savings book equipped with the owner's authorization to withdraw the entire deposit according to the legally binding court decision on the loss of the deposit. The presence of one bidder is sufficient for the auction to take place. The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations, provided that these persons do not submit evidence before the auction begins that they have filed a lawsuit to release the property or items seized with it from enforcement and have obtained a ruling suspending enforcement in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land register or by submitting a document to the collection of documents and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the ruling on the awarding of ownership. According to Article 976 § 1 of the CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
