Przedmiotem licytacji jest nieruchomość rolnicza z budynkami, obejmująca działki nr 207/3 i 207/4 zlokalizowane w województwie warmińsko-mazurskim, powiecie nowomiejskim, gminie Grodziczno, wieś Montowo. Łączna powierzchnia działek wynosi 1,2939 ha. Z danych z księgi wieczystej wynika niezgodność co do numeru działki - w księdze wieczystej jest przypisany jeden numer 207/2. Działka nr 207/2 o powierzchni 1,2939 ha została podzielona na dwie działki, których łączna powierzchnia jest zgodna z danymi z księgi wieczystej. Działki nr 207/3 i 207/4 mają bezpośredni dostęp do publicznej drogi asfaltowej.

Property is built with a residential building and a farm building, located in a dispersed building area of the village of Montowo. The nearest neighborhood consists of residential buildings and agricultural land. The property has access to water and electricity infrastructure. Sewage connects to a local septic tank.

Residential building is located on plot nr 207/3, with an area of 0.1217 ha, the farm building is on plot nr 207/4, with an area of 1.1722 ha.

Farm building occupies an area of 1203 m² (according to land records - symbol B-RIVa), the remaining part of plot nr 207/4 with an area of 1.0519 ha is used for agricultural purposes. The land is flat. The bonitation value of the agricultural land is good, mostly class IVa. The residential area, built from the asphalt road, has a fence made of masonry partly, wooden elements partly, and reinforced concrete elements partly, with a steel mesh on steel posts. There are two gates, one wooden and one made of steel elements.

Residential building - brick, detached with usable attic, partially basement, built around 1980, after renovation and extension in 2005-2008. Building area is 136.00 m², usable area is 172.30 m² (excluding basement) according to the appraiser's measurements, including: ground floor 105.60 m², attic 66.70 m², basement 17.57 m² (height below 2.20m, the expert accepted 50% of the floor area).

Technical description: concrete foundations, walls made of slag block and brick, partially of aerated concrete, insulated with polystyrene + mesh and glue, painted with facade paint. The ceiling over the ground floor is concrete, the attic ceiling is wooden, finished on a wooden frame with panel board, insulated with mineral wool. Multi-pitched roof with wooden structure, covered with boards and thermal welding paper. Internal plaster on ground floor cement-lime, leveled with gypsum, and in the attic cement-lime plaster leveled with gypsum, on the slopes panel boards. Internal walls in the attic are made of wooden structures covered with panel boards. Internal doors are wooden, external doors typical wooden ones. Windows are PVC. The bathroom on the ground floor is fully equipped, with a bathtub, shower cabin, toilet, and sink. Walls and floors finished with tiles. The attic bathroom is finished, equipped with a shower cabin, toilet, and sink. Stairs to the attic are concrete. Gutters are made of PVC, half must be completed. The condition of the building is assessed as good.

Farm building - brick, detached, single-story with part of the usable attic. The shape is L-shaped, according to land and building records, consists of three connected buildings forming one unit. Building area 95.00 m² (former barn) with 1 storey with a two-pitched asbestos roof; building area 53.00 m² with 2 storeys (ground floor and attic) with a two-pitched asbestos roof; building area 37.00 m² with 1 storey, extended and finished with a roof covered with trapezoidal sheet metal. Interior renovated after 2016.

Technical description: concrete foundations, walls made of slag block and other building materials, partially insulated from the side of the municipal road, poured concrete ceiling, in part suspended light ceiling insulated with polystyrene, in part with wool, roof with wooden structure, multi-pitched, covered with asbestos. The recently renovated part is finished with trapezoidal sheet metal, the interior is cement-lime plaster, partially finished with gypsum board, partially with reclaimed panels. Cold room insulated from the inside and finished with PVC panels. External plasters are largely missing in the recently renovated part. The wall from the street is insulated with polystyrene + mesh, glue, and smooth external plaster. Internal doors are wooden and panel, wooden gates, wooden and PVC windows in the recently renovated room. Concrete floors, finished with panels in the renovated part. Gutters are made of galvanized sheet metal. Installations include electrical wiring, connection to the power grid, water from the water supply network, and sewage to a local septic tank. The technical condition of the building is assessed as average.

According to the spatial development plan / study of conditions and directions of spatial development, the property is located in an area designated as residential development.

The auction will end on 13-08-2025 at 10:00

The property is valued at 504 000,00 PLN. The starting price is three-quarters of the estimated value, i.e., 378 000,00 PLN.

The bidder participating in the auction should submit a deposit of 1/10 of the estimated amount, which is 50 400,00 PLN.

The property can be viewed within two weeks before the auction from 10:00 do 18:00. The sale by electronic auction is conducted through the IT system available at: elicytacje.komornik.pl.

Participation in the auction requires registration in the IT system servicing electronic auctions available at: elicytacje.komornik.pl 2 dni robocze przed rozpoczęciem aukcji. Warunkiem uczestnictwa w aukcji jest założenie indywidualnego konta w systemie IT. Wpłata wadium na konto komornika bankowego nr: PKO BP SA 85 10203583 0000 3802 0011 2938 nie później niż 2 dni robocze przed rozpoczęciem aukcji. Dzień wpłaty uznaje się za dzień zaksięgowania środków na koncie komornika. Nie mają zastosowania przepisy art. 964 Kodeksu postępowania cywilnego.

Wraz z wadium, uczestnik licytacji jest zobowiązany do podania w systemie IT danych niezbędnych do wydania decyzji o przyznaniu: numer PESEL, numer dowodu osobistego, oraz oświadczenie, czy jest w związku małżeńskim, a jeśli tak, to czy zamierza nabyć nieruchomość na współwłasność czy na własność osobistą.

Komornik potwierdza fakt wpłaty wadium i podania danych niezwłocznie po ich otrzymaniu, umożliwiając uczestnikowi udział w licytacji. Licytacja rozpoczyna się i kończy o godzinie wskazanej w zawiadomieniu o sprzedaży nieruchomości.

Prawa osób trzecich nie będą stanowić przeszkody w licytacji i przyznaniu własności kupującemu bez zastrzeżeń, o ile te osoby nie przedstawią przed rozpoczęciem licytacji dowodu, że złożyły pozew o zwolnienie od egzekucji nieruchomości lub rzeczy zajętych wraz z nią i uzyskały wyrok zawieszający egzekucję w tym zakresie.

Użycie, służebności i prawa dożywocia, jeśli nie zostały ujawnione w księdze wieczystej lub dołączonym do dokumentu wnioskowym dokumencie, i nie zgłoszono ich nie później niż 3 dni przed rozpoczęciem licytacji, nie będą brane pod uwagę w dalszym toku egzekucji.
