The trustee of the bankruptcy estate of Piotr Augustyniak, in the course of bankruptcy proceedings conducted before the District Court in Czestochowa, VIII Economic Division (case file CZ1C/GUp-s/48/2023), announces a tender for the sale of assets included in the bankruptcy estate in the form of a 1/8 share in the ownership of undeveloped land consisting of plots marked with the registration numbers 1387, 1414, 1419, 1447, and 1484, located in Lubojna in the Mykanow commune for which a land and mortgage register is maintained by the District Court in Czestochowa, IX Land and Mortgage Register Division, land and mortgage register number CZ1C/00100440/9. The starting price for the subject of the tender is 50% of the estimated value, which is 11,700.00 PLN (in words: eleven thousand seven hundred zlotys 00/100). Conditions of the tender: Participation in the tender requires submission by 11.08.2025 of a written, indefinite, and unconditional offer to the address of the trustee's office, ul. Kilinskiego 34, 40-062 Katowice (the date of receipt at the office is decisive). Written offers should include: the name and surname or the name (company) of the bidder, the address (seat) of the bidder, in the case of bidders registered in public registers, an excerpt from the relevant registers with the legal force of an official document, valid on the date of the offer, the phone number and email address of the bidder, if available, the date of the offer, the offered price indicated on the form constituting attachment no. 1 to the regulations formulated precisely (in figures and in words). The offered price cannot be lower than the starting price; in the case of discrepancies between the price indicated in figures and in words, the price expressed in words is decisive, a complete set of statements regarding: familiarization with these regulations and the announcement of the tender, understanding their content and accepting the conditions specified therein without reservations and committing to comply with them; familiarization by the bidder with the factual and legal state of the subject of the tender and not raising objections to it and informing about the exclusion of liability for physical and legal defects under Article 558 § 1 of the Civil Code; committing to cover the costs associated with concluding the sale agreement for the subject of the tender; the bidder's statement that they consent to the processing of their personal data in the scope of the tender procedure covered by these regulations. Proof of payment of the deposit and determination of the method of its return (indicating the bank account number to which the transfer is to be made), if applicable - consent of third parties and resolutions of the corporate bodies of the bidder for the bidder's participation in the tender and conclusion of the sale agreement, if the cases indicated in point i) do not apply - a statement that no consents of third parties or resolutions of any entities or bodies for the bidder's participation in the tender and conclusion of the sale agreement are required. The offer should be submitted in a sealed envelope with a clear note "DO NOT OPEN - TENDER - PIOTR AUGUSTYNIAK, CASE FILE CZ1C/GUp-s/48/2023". A condition for participation in the tender is a prior payment of a deposit in the amount of 1,170.00 PLN (in words: one thousand one hundred seventy zlotys 00/100) to the bank account of the bankruptcy estate of the debtor Piotr Augustyniak with the number: 35 1600 1462 1745 5231 0000 0001. The recognition of the bank account of the bankruptcy estate must occur no later than 11.08.2025. All bank fees related to the deposit transfer are borne by the bidder. The opening and consideration of offers will take place on 13.08.2025 at 09:00 at the trustee's office, ul. Kilinskiego 34, 40-062 Katowice. Each bidder is entitled to participate in the meeting at which the offers will be considered. Offers not in accordance with the regulations will be rejected. The method of payment for the subject of the tender: transfer of 100% of the sale price, reduced by the deposit, in such a way that the recognition of the bank account of the bankruptcy estate occurs no later than the day before the conclusion of the sale agreement for the property. All costs associated with the sale of the subject of the tender are borne by the buyer. The conclusion of the sale agreement for the subject of the tender must occur no later than within 4 months from the selection of the offer at the notary office indicated by the trustee, within the time specified by the trustee. Based on Article 701 § 3 of the Civil Code - the trustee reserves the right to freely choose the offer and the right to cancel, interrupt or invalidate the tender without giving reasons.
