The bankruptcy trustee in the bankruptcy proceedings conducted before the District Court in Opole under case number OP1O/GUp/4/2024 will sell a 47/100 share in the perpetual usufruct of the real estate located in the area of 0103 Opole, designated as plots 167/1, 167/2, 167/3, AM-54 with a total area of 0.7026 ha, municipality M. Opole, district M. Opole, Opole Voivodeship, for which the District Court in Opole maintains land and mortgage register number OP1O/00020024/5 (ul. Marii Rodziewiczowny 6, Opole) under the following conditions: 1. The sale will take place for the highest price possible on the market, but not less than 1,250,000.00 PLN, 2. Offers to purchase the asset of the bankrupt in a sealed envelope, preventing its opening with the note - to the Trustee Miroslaw Piechowiak, proceedings for the sale of the share, case number OP1O/GUp/4/2024, do not open - must be submitted by September 10, 2025, by 12:00 at the address of Trustee Miroslaw Piechowiak, ul. 1-go Maja 30a, 45-355 Opole (if you wish to personally leave the offer, you must arrange with the trustee at 694 568 778 at least one day in advance the date and time of leaving the offer) - the date of receipt counts, 3. The bidder must pay a deposit of 50,000.00 PLN (fifty thousand zlotys 00/100) to the bankruptcy estate's bank account by September 10, 2025: Trustee Miroslaw Piechowiak, account number 05 1090 1522 0000 0001 5926 6500, 4. The offer should include: a) exact identification of the bidder: first name, last name (company), place of residence (seat) and contact phone number, b) offered sale price and subject, c) in the case of entrepreneurs: current extract from KRS or business activity register (CEIDG), and PESEL number in the case of offers submitted by individuals, d) original power of attorney or its photocopy certified as true to the original by a notary, in the case of submitting an offer by an attorney e) all permits and consents, if required by law due to the buyer's identity, f) the bidder's commitment to cover all costs and fees related to the purchase, g) a statement of having familiarized oneself with the legal and factual state of the asset offered by the Trustee, and consent to exclude liability for physical and legal defects based on Article 558 § 1 of the Civil Code, h) proof of deposit payment, 5. An offer that does not contain at least one of the elements specified in point 4, submitted after the deadline or with a failure to pay the deposit will not be considered, 6. The offers will be reviewed on September 17, 2025, at 11:00 at the office of Trustee Miroslaw Piechowiak, ul. 1-go Maja 30a, 45-355 Opole, 7. Submission of one offer is sufficient for the sale to take place, 8. In the case of equal offers, an oral auction will be held at a time set by the trustee, with the following conditions: a) bidders who submitted equal highest offers will be allowed to participate in the auction; by which is understood those in which the offered sale price differs by no more than 1% of the total minimum price specified in point 1, rounded up to full hundreds of zlotys; b) bidding during the auction will be set at 5,000.00 PLN; c) the starting price will be the highest price indicated in the offer; d) detailed auction conditions will be specified by the trustee, 9. The trustee will select the most advantageous offer, 10. The bidder whose offer is selected is obliged to conclude a sales agreement within the time set by the trustee and by the date of concluding the agreement must pay the entire offered price, 11. The sale price must be paid in full, no later than on the day of concluding the sales agreement - before its conclusion, 12. The deposit submitted by the bidder will be credited towards the sale price. The remaining bidders will have their deposits returned without interest and remuneration within 14 days from the date of selection of offers, 13. If the buyer does not fulfill the sale conditions, they lose the deposit, which is forfeited to the bankruptcy estate, and the effects of the selection of the offer expire, 14. All costs of checking the subject of sale and concluding the agreement are borne by the buyer, 15. The buyer agrees to exclude liability for physical and legal defects of the subject of sale based on Article 558 § 1 of the Civil Code, 16. The conditions of the sales agreement set by the trustee are not subject to negotiation; the trustee is solely authorized to select the notary before whom the activities related to the sale will be carried out, 17. The content of the sales agreement is not subject to negotiation, 18. The trustee reserves the right to withdraw from the sale, cancel the sale proceedings or invalidate it at any stage of the proceedings without giving reasons, 19. In matters not regulated by these conditions, the provisions of the Bankruptcy Law and the provisions of the Civil Code shall apply accordingly, 20.
