Conditions of sale by private treaty in the proceedings number VI

I). Subject of sale: Ownership rights to the developed land plot no. 89 located in Glogow, cadastral district 0003 - cathedral island, ul. Kamienna Droga 48, with an area of 0.1727 ha for which the District Court in Glogow, V Land Registry Department maintains land register KW no. LE1G/00024991/8, with the reservation that a 50% share in the ownership rights belongs to Krzysztof Ostaszewski and a 50% share in the ownership rights belongs to Renata Maria Ostaszewska.

II). Definition of the bankrupt: Krzysztof Ostaszewski, Renata Maria Ostaszewska - residing at ul. Kwiatowa 10, 59-160 Radwanice.

III). Definition of the Court and case reference: District Court in Legnica, Economic Department V, ul. Zlotoryjska 19, 59-220 Legnica, Case Ref. LE1L/GUp/7/2023, Case Ref. LE1L/GUp/8/2023.

IV). Basis for disposal: Decision of the District Court in Legnica dated August 30, 2024, Case Ref. LE1L/GUp/7/2023, Case Ref. LE1L/GUp/8/2023.

1). The sale takes place by private treaty, in a public offer.

2). The sale may occur for the highest price obtainable on the market, but not lower than 1,122,500.00 PLN.

3). The procedure for the sale by private treaty is written, offer-based - subject to point 17 of these conditions.

4). The offer with the highest proposed sale price binds the bidder and constitutes the most advantageous offer in the course of the offer procedure for the sale of the subject of the proceedings - until the resolution of any auction referred to in point 17 of these conditions.

5). Those participating in the proceedings must, under penalty of exclusion from participation, pay a deposit to the bankruptcy estate's bank accounts by August 26, 2025 in the amount of:

56,125.00 PLN - must be paid to 30 1020 5242 0000 2102 0620 9524, account designation: Michał Błaszczyszyn and additionally

56,125.00 PLN - to account number 92 1020 5242 0000 2102 0619 3082 3082 account designation: Michał Błaszczyszyn

6). The deposit paid by the bidder whose offer was selected will be credited towards the purchase price, and if the sale agreement is not concluded within two months from the date of approval of the selection of the offer by the Commissioner Judge due to the fault of the bidder, the deposit will be forfeited to the bankruptcy estate. Other bidders will have their deposits returned within 14 working days from the approval of the offer.

7). The bidder whose offer was selected is obliged to conclude the sale agreement within two months from the date of approval of the selection of the offer by the Commissioner Judge and by the date of concluding the agreement must pay the entire offered price.

8). The costs of verifying the subject of sale and concluding the agreement are borne by the buyer.

9). The buyer agrees to exclude liability for physical and legal defects of the subject of sale.

10). The terms of the sale agreement established by the syndic are not subject to negotiation; the syndic is entitled to choose the notary before whom the activities related to the sale will be carried out.

11). The offer must include:

  • identification of the bidder, proposed purchase price of the asset, signature of the bidder or authorized person acting on their behalf, contact phone number,
  • original or photocopy of the certificate of entry in the relevant register of entrepreneurs or a notarized copy of the identity card if the bidder is a natural person,
  • original or photocopy of the decision of the relevant Tax Office granting the tax identification number (NIP),
  • original or photocopy of the certificate of the identification number REGON issued by the relevant Statistical Office,
  • original or photocopy of any granted power of attorney or its photocopy confirmed as compliant with the original by a notary,
  • statement of consent to cover all costs related to the transfer of ownership,
  • statement of having familiarized oneself with the condition of the auction subject including legal and technical aspects and a statement of consent to exclude liability for physical defects under Article 558 of the Civil Code,
  • consent or promise of consent from the Minister of Internal Affairs for the acquisition of the subject of sale in the case of a bidder from outside the European Economic Area and the Swiss Confederation,
  • confirmation of deposit payment

12). An offer not containing at least one of the above will not be considered.

13). Submission of one offer is sufficient to effect the sale.

14). Offers in Polish or translated into Polish by a sworn translator in sealed envelopes preventing their opening with a clear and legible identification of the bidder, as well as the note "Proceedings for sale - LE1L/GUp/7/2023 and LE1L/GUp/8/2023 - DO NOT OPEN" must be submitted by August 26, 2025 to the address: Syndic's Office, Court Supervisor, Manager Dr. Michał Błaszczyszyn, PO Box 102, 53-350 Wroclaw 15. The date of receipt counts.

15). The offers will be reviewed on August 28, 2025, at 10:00, place of offer review: Syndic's Office in the presence of all interested parties.

16). The review of offers will be made in terms of compliance with the conditions of the offer procedure, which are specified above and the proposed purchase prices.

17). In the case of equivalent offers, an oral auction may be held on August 28, 2025, at 10:15, place of auction: Syndic's Office with the following conditions:

  • those bidders who submitted equivalent highest offers will be allowed to participate in the auction; by which we mean those where the offered sale price differs by no more than 1% of the minimum price determined according to point 2, rounded up to full hundreds of zlotys,
  • the bidding during the auction will be set at 1,000.00 PLN net.
  • the starting price will be the highest price indicated in the offer,

18). The selection of the most advantageous offer will be made by the Syndic, the selection requires the approval of the Judge - Commissioner.

19). The price must be paid no later than at the time of concluding the agreement - before its conclusion.

20). In matters not regulated by these conditions, the provisions of the Bankruptcy Law and the provisions of the Civil Code shall apply accordingly.

21). The possibility of canceling in whole or in part the sale proceedings or its annulment at any stage of the proceedings without giving reasons is reserved.
