In the case of discrepancies, the value indicated in words is accepted. A statement that the offeror has familiarized themselves with the technical and legal condition of the auction subject and does not raise any objections to it. In the case of acting through an attorney, the power of attorney should be granted in writing with a notarially certified signature. The offered price must be given in Polish currency. Each offeror may submit only one offer. The condition for participation in the auction is also the payment of a deposit in the amount of 1/10 of the starting price to the bank account of the bankruptcy estate maintained by BNP Paribas with the number 62160014621855419620000001. The deposit must be credited to the bank account of the bankruptcy estate no later than 2 (two) days before the opening and consideration of offers. If the deposit is not credited to the bank account of the bankruptcy estate by the deadline described above, the offeror will not be allowed to participate in the auction. In the case of at least two highest offers differing in price, the offer that was submitted earlier will be selected. If the offer of a given offeror is selected, the deposit is credited towards the sale price. The buyer bears all costs and burdens (taxes, fees) related to concluding the sale agreement and transferring rights, including in particular the costs of the notarial deed and costs related to the possible removal of encumbrances from the land and mortgage register. A protocol will be drawn up from the course of the auction. Offsetting claims due to the buyer against the bankrupt with the purchase price is inadmissible. Before concluding the sale agreement, the offeror is obliged to pay the remainder of the auctioned price to the bank account of the bankruptcy estate within 30 days from the date of the auction and to proceed to the notarial deed of sale no later than within the next 14 days from the date of payment of the remainder of the price under the penalty of forfeiture of the deposit to the bankruptcy estate. The sale conducted in bankruptcy proceedings has the effects of enforcement sale with the consequences provided for in Article 313 of the Bankruptcy Law. The syndic indicates the Notary Office where the notarial deed of sale of the property will be signed. The syndic reserves the right to cancel the auction at any time until the moment of signing the sale agreement. In the event of cancellation of the auction after selecting the offeror, the syndic immediately returns the paid deposit. The return occurs in the form of a transfer to the bank account from which the deposit was made. For the time the deposit amount remains in the bank account of the bankruptcy estate, the offeror is not entitled to any interest.
