The Court Bailiff at the District Court in Mielec, Lukasz Dziuban, informs based on art. 986[4] of the Code of Civil Procedure that on the day of 28.08.2025 at 9:00 AM, an electronic auction of the property described as: ownership of the land property marked as plot no. 264 with an area of 2.2500 ha, built with a single-family detached residential building with a building area of 107.00 m2 and an economic building of economic-garage function, brick, single-story with a building area of 110.00 m2 as well as a second economic building made of solid brick and partially hollow slag block, with a building area of 92.00 m2. The property is located in Wampierzow, in the area of 0110, in the municipality of Wadowice Gorne, in the mielecki district, in the Podkarpackie Voivodeship, for which the District Court in Mielec V Land and Mortgage Register Department maintains KW no. XXX. The auction will end on 04.09.2025 at 2:00 PM - based on art. 986[7] after § 3[1] of the Code of Civil Procedure, if within 5 minutes before the planned end of the auction, a bid is submitted, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the auction end time is extended by another 5 minutes until the bids cease. The estimated price of the above property is 451,700.00 PLN. The starting price in the above auction is three-quarters of the estimated value reduced by the value of the personal servitude and the value of lifetime use (i.e. by the amount of 145,800.00 PLN), which is 192,975.00 PLN. Those participating in the auction, according to art. 986[5] § 1 of the Code of Civil Procedure, are obliged to submit a deposit of 10% of the estimated price, which is the amount of 45,170.00 PLN no later than two working days before the auction day. The deposit can be paid to the Bailiff's account in Mielec no: 38 2030 0045 1110 0000 0314 7750 Bank BGZ BNP Paribas S.A. The authority informs about the content of the above provision, according to which the date of the deposit is considered the day the Bailiff's bank account is credited. Therefore, the deposit should be paid in advance so that it is in the Bailiff's bank account 2 days before the auction starts. The personal servitude and the right of lifetime use disclosed in the Land and Mortgage Register remain in force (the buyer will take possession of the property along with the encumbrances) according to art. 1000§3 of the Code of Civil Procedure. In the two weeks before the auction, the above-mentioned property can be viewed on weekdays after prior arrangement of the date with the Bailiff. The protocol of description and valuation can be viewed at the Bailiff's Office from Monday to Friday from 8:00 AM to 4:00 PM, and is also available in the announcement on the website of the National Council of Bailiffs. Those participating in the auction are obliged to create an individual account in the IT system, provide the data necessary to issue the decision on the award: PESEL number, identity document number, and a statement of whether they are married, and if so, whether they intend to acquire the property for joint property, and to indicate whether they are bidding in their own name or as an agent of another person. The auction is conducted based on the provisions of the Code of Civil Procedure regulating the procedure for the auction of real estate by electronic means. In particular, according to the provisions of art. 986[4] and subsequent of the Code of Civil Procedure, the condition for participation in the auction is the creation of an individual account in the IT system. Along with the deposit, the bidder is obliged to provide in the IT system the data necessary to issue the decision on the award: PESEL number, identity document number, and a statement of whether they are married, and if so, whether they intend to acquire the property for joint or personal property, and to indicate whether they are bidding in their own name or as an agent of another person. If necessary, the Bailiff will immediately summon the bidder, under penalty of exclusion from participation in the auction, via the IT system to complete the data. The Bailiff confirms the fact of the deposit and data submission immediately after receiving them by allowing the bidder to participate in the auction. A refusal to allow participation in the auction is communicated to the interested party via the IT system. The buyer is obliged to pay the purchase price immediately after being awarded. The remaining price, which includes the submitted deposit, is paid on the next day during the office hours of the bailiff's office or to the bailiff's bank account by 6:00 PM the next day. If this day falls on a Saturday or a public holiday, the price is paid on the next day after the day or days off. The remaining bidders will have their deposits returned immediately after submitting a written request for a refund indicating the bank account. The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit evidence before the auction starts that they have filed a lawsuit for exemption from the enforcement of this property or other items seized with it and obtained a judgment suspending the enforcement. Use, servitudes, and lifetime rights, if not disclosed in the land and mortgage register and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.
