NOTICE OF THE FIRST AUCTION OF THE PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Kielce announces to the public that in case KM 2866/24 on the date: 18.09.2025 at 12:00 the first auction will begin in the manner specified in art. 9864 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC) in electronic mode for the following property:

- property located at ul. Madejówka, gm. Strawczyn, Promnik.

Property description:

The property includes plot 230/28 with a total area of 0.0746 ha. It is built with a single-family residential building with a usable area including a garage of 183 sqm comprising the ground floor and usable attic. Construction started in 2000. On the ground floor, there are 3 rooms, a kitchen, a bathroom, a boiler room, a hall, communication, and a garage. The attic rooms are unfinished.

The estimated value is 544,808.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 408,606.00 PLN.

For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 14:00 to 18:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 54,480.80 PLN. The deposit must be submitted to the bailiff's bank account 17102026290000950200158683 no later than 2 business days before the auction starts.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at the address elicytacje.komornik.pl and joining the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient to hold the auction.

Based on art. 9864 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties are held in electronic mode and will end on: 25.09.2025 at 12:00. Based on art. 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended each time by another 5 minutes until the bids cease.

The rights of third parties will not prevent the auction and the award to the buyer without reservations if these persons do not submit proof that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending enforcement before the auction starts.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership.

According to art. 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
