NOTICE OF SECOND AUCTION OF THE PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Kielce announces to the public that in case KM 1646/23 on the date: 11.09.2025 at 12:00 an electronic auction will begin in the manner established in Article 9864 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC) second auction in electronic mode of the following properties:

- property located at Ogrodowa St, 26-065 Piekoszow.

Property description:

Plot 1142/3 built with a house with a usable area of 149.73 sqm and a building area of 33.30 sqm. The house was built in 1987 and consists of 3 levels.

The estimated value is 458,727.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 305,818.00 PLN.

In the two weeks before the auction, the above-mentioned property can be viewed on weekdays from 14:00 to 18:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 45,872.70 PLN.

The deposit must be submitted to the bailiff's bank account 17102026290000950200158683 no later than 2 working days before the auction begins.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at the address elicytacje.komornik.pl and participating in the auction two working days before its start. The bidder submits the deposit no later than 2 working days before the auction begins, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

Based on Article 9864 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties take place in electronic mode and will end on: 18.09.2025 at 12:00. Based on Article 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit proof that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending the enforcement before the auction begins.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction begins, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

According to Article 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
