NOTICE OF THE FIRST AUCTION OF REAL ESTATE

IN THE FORM OF ELECTRONIC AUCTION

Judicial Officer at the District Court in Wloclawek Mariusz Malinowski announces to the public that in case GKm 33/23

on the day: 03.09.2025 at 10:00

the first auction will commence in the manner specified in Article 986* § 4 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc)

first auction in electronic form

of the following properties:

- property located at Machnacz, 87-880 Brześć Kujawski, for which the District Court in Wloclawek, Land and Mortgage Register Department (address: ul. Kilińskiego 20, Wloclawek, 87-800 Wloclawek) maintains a land and mortgage register with the number WL1W/000xxxxx/7.

Property description: plots no. 297/5, 297/6, with an area of 0.7556 ha. The plots have a regular compact shape, favorable. Access to the public road via an internal road co-owned by the owners of the plots adjacent to the internal road (plot no. 297/10, for which a land and mortgage register is maintained with the number KW WL1W/000xxxxx/0).

For plots no. 297/5 and 297/6, which are the subject of the auction, shares in the internal road (plot no. 297/10) are secured in the amount of 4/16 parts and no enforcement is being conducted against them (They are to be sold together with plots no. 297/5 and 297/6). Therefore, the aforementioned plots do not have access to the public road.

The estimated value is 305,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 228,750.00 PLN.

Within two weeks before the auction, the aforementioned property can be viewed on weekdays from 09:00 to 15:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit in the amount of one-tenth of the estimated value, which is 30,500.00 PLN. The deposit must be submitted to the judicial officer's bank account 66 1540 1069 2001 8718 2520 0001 no later than 2 business days before the auction starts. The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system that supports electronic auctions available at the address and joining the auction two business days before its start. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place. Based on Article 986* § 2 of the kpc, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the aforementioned properties will take place in electronic form and will end on: 10.09.2025 at 10:00. Based on Article 986'po § 3 of the kpc, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes.

If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease. The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending the enforcement in this regard.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.
