Areas for service and production development with multifunctional purpose UP
Function (purpose) of the area
1) primary purpose: service and production facilities with multifunctional purpose, as mentioned in § 4 sec. 1 point 18, with arranged greenery in part of the UP area marked on the plan drawing Z/UP,
2) complementary purpose:
a) facilities and devices necessary for technological, social, fire protection reasons,
b) communication devices, technical infrastructure, and environmental protection for the needs of the plot or local needs,
c) farm buildings in agricultural holdings indicated on the plan drawing as UP/MR plots,
d) networks of technical infrastructure at the local and regional level not related to the Katowice Route and parking spaces located in the UP area between the road boundary of the Route and the untransgressable building line from the Route,
3) permissible purpose:
a) the plan allows for the retention of single-family residential development and residential with service function on invested areas, as mentioned in § 4 sec. 1 point 21,
b) the plan allows for the temporary retention of agricultural holdings indicated on the plan drawing as UP/MR plots,
c) in exceptional cases on the UP area, outside the designated impact range of the Route, the plan allows for the location of agricultural holdings according to the conditions mentioned in § 107 to § 113,
d) along the southern boundary of the Katowice Route, in the area between the road boundary and the untransgressable building line from the Route, the plan indicates a corridor for the implementation of a commuter railway,
4) the plan prohibits:
a) locating new single-family residential development, health care facilities, medical services, and facilities related to prolonged stays of children and youth,
b) the location of provisional facilities except for those necessary during construction,
c) development of forest enclaves Ls,
4) until the implementation of the purpose mentioned in point 1, the plan establishes the maintenance of the current method of land use and development and agricultural holdings indicated on the plan drawing as UP/MR plots,
5) development may be subject to exchange, expansion, reconstruction, and change of use provided that the established purpose in points 1, 2, 3 is maintained.

Development rules and conditions:
1. Plot:
1) the minimum area of new plots is set at 0.3 ha,
2) raising the level of the plots above the level of neighboring plots is prohibited, as well as draining rainwater onto neighboring plots and roads and unauthorized filling and lowering of the land surface.
2. Development shaping rules:
1) the plan establishes such a method of investment that on each building plot at least 20% of the area is preserved as biologically active green space and also as water areas,
2) for plots located along Zimna Woda, the plan establishes a zonal method of development, meaning that each plot consists of two parts; to the boundary of W.O.CH.K. (part marked UP) designated for development and investment and from the boundary of W.O.CH.K to the fence line from the river (part marked Z/UP) designated exclusively for arranged greenery and water reservoirs (accumulation-evaporation),
3) the appearance, technical standard, and functional characteristics of volumetric development in administrative decisions must be subordinated to the following assessment criteria:
a) the form of new buildings should be shaped in reference to contemporary architecture, without restrictions on construction and finishing materials,
b) the plan advocates the use of sloped roofs,
c) basements are excluded from buildings on plots with a high groundwater level,
d) the plan establishes that the length of a building or group of buildings (in one direction) cannot exceed 100 m and that individual segments should have varied heights or facade planes. This restriction does not apply to development along the Katowice Route,
4) it is advocated that development is carried out according to a unified concept (harmonized heights, architectural forms, color of coverings and facades, and small architecture) for building complexes constituting one investment,
5) places for architectural visual closures created by street facades are designated,
6) advertisements and other informational signs should be located along the boundary lines of roads.

Building height:
1) according to the definition recorded in § 4 sec. 1 point 22, the plan establishes:
a) building height up to 12 m for plots of 0.3 ha,
b) building height up to 20 m for plots over 4.0 ha,
c) height of lighting and telecommunication masts up to 35 m on plots over 4.0 ha,
2) on plots adjacent to existing residential development, from the common boundary side, the building height is established up to 12 m,
3) the plan indicates on the plan drawing places for local dominants.
