NOTICE OF THE FIRST AUCTION OF THE PROPERTY

Court Bailiff at the District Court in Aleksandrow Kujawski Jakub Marchlewicz based on art. 953 of the Code of Civil Procedure announces to the public that:

in the building of the District Court in Aleksandrow Kujawski located at ul. Narutowicza 16 in room No. 104, there will be held

the first auction

of the property consisting of

plots No. 85/2, 86 with a total area of 12.8891 ha (according to land records 12.5697 ha), plot 85/2 partially built with a single-family house with an area of approx. 120m2 and 4 farm buildings with a total area of approx. 687m2.

located at: 87-721 Raciążek, Niestuszewo, for which the District Court in Aleksandrow Kujawski IV Department of Land and Mortgage Registers maintains the land and mortgage register No. KW WL1A/000xxxx/8

The estimated value is 952,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 714,000.00 PLN.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 95,200.00 PLN. The deposit should be made in cash or in a savings book of banks authorized under banking law equipped with the owner's authorization to withdraw the entire deposit according to the court's valid decision on the loss of the deposit. The deposit can also be paid to the bailiff's account: Powszechna Kasa Oszczędności Bank Polski SA Branch 1 in Ciechocinek 27 10205200 0000 4102 0046 3273 no later than the day before the auction.

According to the provisions of art. 976 §1 of the Code of Civil Procedure, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission, as well as other persons mentioned in this article, cannot participate in the auction.

In the two weeks prior to the auction, the property can be viewed on 15.05.2025 from 16:00 to 16:30 and the protocol of the property valuation, the expert's valuation report, and the extract from the land register along with a map from the enforcement proceedings can be reviewed at the bailiff's office.

The rights of third parties will not be an obstacle to the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the property or items seized with it from enforcement and have obtained a ruling suspending the enforcement in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the ruling on the awarding of ownership.
