2. Provisions regarding the principles of protection and shaping spatial order.
1) In the areas referred to in paragraph 1, the following are permitted:
a) networks and technical infrastructure devices,
b) access roads, parking spaces, maneuvering areas, etc.,
c) arranged greenery along with sports and recreation facilities,
d) farm buildings, garages,
e) adaptation of existing multi-family residential buildings with the possibility of
carrying out construction works in accordance with the parameters and indicators specified in paragraph 3,
f) non-intrusive facilities related to gardening activities, except for investments
that may significantly impact the environment in accordance with existing regulations
in this regard,
g) adaptation of existing facilities related to vehicle servicing with the possibility of
expansion not exceeding 25% of the total area of existing facilities.
2) In the areas referred to in paragraph 1, the following prohibitions apply:
a) location of functions with nuisances exceeding the boundaries of the investment area,
b) implementation of bases, new warehouses, fuel stations,
c) implementation of new service facilities in the automotive sector,
d) implementation of functions designated in the plan without ensuring the necessary number of parking spaces specified in chapter 8,
e) implementation of new collective garages, except for garages for residential development carried out in a terraced form,
f) implementation of fences made of sheet metal or concrete, prefabricated elements on
the fronts of plots.
3) In the areas referred to in paragraph 1, the following obligations apply:
a) For newly constructed facilities, the use of traditional materials in
finishing elements is mandatory, such as: clinker brick, ceramic tiles, or
other material imitating tiles, wood, etc.,
b) there is an obligation to adapt the geometry of roofs and finishing materials
of the facades of newly constructed farm buildings and garages to residential or service buildings located within the plot,
c) for collective garages referred to in point 3 lit. e, there is an obligation to maintain
a uniform form, roof geometry, and unified finishing elements
of the facades, including: color schemes, used finishing materials,
d) maintaining the necessary distances of the constructed buildings from networks and technical infrastructure devices in accordance with specific regulations in this regard.
4) For existing buildings, the possibility of carrying out all construction works is established
in accordance with the requirements specified in this resolution,
5) It is established that residential development will be carried out in a free-standing, terraced, or
duplex form.
6) The possibility of implementing both service and residential functions within one
plot or on separately designated plots is established.
3. Provisions regarding the parameters and indicators for shaping development and land management.
1) The maximum height of residential and service buildings is established - 3 above-ground floors including usable attics.
2) the maximum height of farm buildings and garages is established - 1 above-ground floor + attic,
3) flat or sloping roofs with a slope angle of up to 45° are required;roofs with a slope angle of up to 15° may only be implemented in facilities with
a maximum height of 2 above-ground floors,
4) biologically active area should constitute a minimum of 45% of the area of the plot or
investment area,
5) the maximum indicator of built-up areas (Pz) is established - 0.45,
6) deviations from the parameters and indicators of development established in the plan are permitted in areas that were built before the resolution came into force, where the construction process has begun, or whose size makes it impossible to maintain the provisions related to biologically active area, the built-up area indicator.
Deviations do not apply to the possibility of raising buildings to a height higher or
in accordance with the plan provisions, changing the slope angle of roofs when raising
buildings,
7) the distance of buildings from the outer edge of the street has been specified in chapter 8.
4. Provisions regarding the detailed rules and conditions for merging and dividing properties.
1) In the areas, merging and divisions of properties are permitted,
2) there is a prohibition on designating plots without ensuring access to the street, except in
cases where the designation of a plot serves to enlarge another plot that has access to the street,
3) divisions should take into account the possibility of implementing investment intentions
4) on newly designated plots in accordance with the parameters and indicators for shaping development and technical conditions specified in specific regulations in this regard,
5) it is established that the area of newly designated plots should be:
a) for residential development carried out in a terraced form, the minimum size
-160m², minimum width of plot fronts - 6m,
b) for residential development carried out in a duplex form, the minimum size
-300m², minimum width of plot fronts - 12m,
c) for residential development carried out in a free-standing form, the minimum size
- 500m², minimum width of plot fronts - 16m,
6) newly designated plot boundaries should be perpendicular to the street or parallel
to the boundaries of neighboring plots with a tolerance of up to 45 degrees.
