ANNOUNCEMENT OF AUCTION Based on Article 28, paragraphs 1 and 2, and Article 38, paragraph 1 of the Act of August 21, 1997, on real estate management (consolidated text Journal of Laws of 2024, item 1145, as amended) and the Regulation of the Council of Ministers of September 14, 2004, on the method and procedure for conducting auctions and negotiations for the sale of real estate (consolidated text Journal of Laws of 2021, item 2213), The Mayor of Kroczyce announces the second oral unlimited auction for the sale of real estate owned by the Municipality of Kroczyce according to the list below. Based on Resolution No. 455/LXIV/2024 of the Kroczyce Municipal Council of April 23, 2024, regarding the sale of real estate located in Siedliszowice, the following property has been designated for sale: No. 1 Property designation 332, k. m. 6 District Siedliszowice KW No. (encumbrances) CZ1M/00027085/6 (no mortgage encumbrance or other obligations). Property area [ha] 0.4821 Property description The property is a built-up land classified as Ls - forests class V, B - built agricultural land RVI, and Ps - pasture class VIz. The property is located in Siedliszowice in a residential and agricultural development area. The property has a regular rectangular shape with a width of 15 meters on flat and leveled terrain. It is located to the north by provincial road No. 1775 S, and to the south by a dirt road leading to the fields. There is a detached residential building made of limestone on the property. There are no registrations at the property. The roof structure is wooden, covered with cement tiles. The building is not plastered on the outside. The total wear of the building at the level of 86% qualifies it for demolition. Reconstruction requires very large expenditures. The plot is currently unutilized and undeveloped, mostly overgrown with bushes and trees. The vegetation consists of self-seeding, root shoots of trees, and cut old pine trees. According to Resolution No. 90/XIII/2019 of the Kroczyce Municipal Council of December 18, 2019, regarding the local spatial development plan for the area of Siedliszowice in the Kroczyce Municipality, the above symbols mean: 4 MN - land purpose - single-family residential development. The following is allowed: a) farm buildings, with a total building area of buildings other than residential not exceeding 20% of the building plot area, b) non-intrusive services: in single-family residential buildings, in mixed-use residential buildings, where the total usable area used for service purposes does not exceed 50% of the usable area of the building, as service buildings with a total building area not exceeding 20% of the building plot area, c) above-ground parking on an area not larger than 20% of the building plot area, 11ZL1 - establishes: 1) land purpose: a) forest land, b) buildings and facilities related to forestry, c) tourist facilities related to forestry such as: forest parking, camping sites, observation towers, footbridges, hiking trails, educational paths, and viewpoints, 2) principles of shaping development and land development indicators: a) the height of permitted buildings shall not exceed 25 m. 1KDZ - establishes: 1) land purpose - public road of "collector" class, 2) principles of land development: a) the width of the 1KDZ road in the delineation lines - from 10 to 20 m, in accordance with the designation on the plan drawing. Conditions for participation in the auction: The second oral unlimited auction for the sale of the property designated by the registration number 332 located in the Siedliszowice registration district will take place on September 9, 2025, at 10:00 AM at the seat of the Kroczyce Municipality Office, ul. Batalionów Chłopskich 29, 42-425 Kroczyce, room No. 15. The condition for participation in the auction is the payment of the deposit specified in the announcement. The deposit must be paid in cash to the Bank Spółdzielczy Szczekociny Kroczyce Branch account No. 69 8277 0002 0030 0000 4269 0002 by September 4, 2025. The deposit paid in cash must be credited to the Kroczyce Municipality Office account no later than September 4, 2025. The deposit is credited towards the purchase price for the winning bidder, while the remaining participants in the auction will have their deposits returned. If the person designated as the buyer of the property fails to appear without justification to conclude the contract at the place and time specified in the notification, the seller may withdraw from the sale agreement, and the paid deposit is non-refundable. The purchase price, equal to the price achieved in the auction, must be paid by transfer to the Kroczyce Municipality account No. 96 8277 0002 0030 0000 4269 0001 and must be recorded in the Kroczyce Municipality bank account no later than one day before the notarial contract is concluded. The costs of concluding the notarial contract and court fee costs are borne by the buyer. A person participating in the auction must present proof of deposit payment and proof of identity, and a person representing a legal or natural person in the auction must additionally present a complete set of documents for their representation. In the case of property acquisition by foreigners, the provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners (consolidated text Journal of Laws of 2017, item 2278) apply. The auction will end positively if at least one of the participants proposes a bid of at least 1% of the starting price rounded up to the nearest tens of zlotys. The auction winner will be informed of the date and place of the sale agreement conclusion within 21 days from the date of the auction resolution. The Mayor of Kroczyce reserves the right to cancel the auction for important reasons and reserves the right to close the auction without selecting a buyer.
