NOTICE OF SECOND AUCTION OF PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Gorzow Wielkopolski, Bailiff's Office No. IX in Gorzow Wielkopolski, announces to the public that in case Km 2630/21 on: 22.08.2025 at 12:00 the second auction will begin in the manner established in Article 9864 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC) in electronic mode for the following properties:

- residential premises located at Gralewo 66-431 Santok

Property description:

The subject of the auction is a residential property located in the village of Gralewo, gm. Santok, for which the District Court in Gorzow Wlkp. The residential premises are located on the first floor of a low-rise multi-family residential building, completely basement. The usable area of the premises is 49.60 m², consisting of two rooms, a kitchen, a bathroom with a toilet, and a hallway. The premises have a balcony. The owner of the premises has a share of 643/10000 in the co-ownership of the land plot and common parts of the building. The premises do not have an attached room, however, as part of the co-ownership of the common parts of the building, the owner of the premises can use the basement room located at the level of the underground floor of the building with an area of 11.04 m². The building in which the residential premises are located is on land plot No. 10/23, was put into use in the early 1980s - the technical condition of the building was assessed by the property appraiser as satisfactory. According to the property appraiser's valuation, the residential premises are in satisfactory technical condition. The heating of the premises is individual - a dual-function gas boiler (heating and hot water). A full range of networks is available: energy, gas, water supply, sewage network, RTV. The finishing condition of the premises was assessed by the property appraiser as basic. A detailed description of the property is included in the valuation report.

The estimated value is 175,600.00 PLN, while the starting price is equal to 2/3 of the estimated value and amounts to 117,066.67 PLN.

In the two weeks before the auction, the above-mentioned property can be viewed on weekdays from 08:00 to 15:00. The protocol of description and valuation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 17,560.00 PLN.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at elicytacje.komornik.pl/ and joining the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

Based on Article 9864 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties will take place electronically and will end on: 29.08.2025 at 12:00.

According to Article 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction deadline is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not prevent the auction and the awarding to the buyer without reservations if these persons do not submit proof that they have filed a lawsuit to exempt the items from enforcement and obtained a judgment suspending enforcement before the auction starts.

Use, easements, and rights of a lifetime, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

According to Article 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
