NOTICE OF THE FIRST AUCTION
The Court Bailiff at the District Court Gdansk-South in Gdansk, Alicja Julke-Kostrzewa, Bailiff's Office No. V in Gdansk 80-138 Gdansk ul. Kartuska 137/2, based on Article 986 with index 4 § 3 of the Code of Civil Procedure, announces to the public that in the case KM 3570/14 (main files) and subsequent attached files on
September 4, 2025 at 11:30 AM on the e-auctions portal, the first auction will begin in electronic mode for the cooperative ownership right to a residential unit with an area of 52.30m2 consisting of 3 rooms, a kitchen, a hallway, and a bathroom belonging to the debtor: xxx located at: 80-030 Gdansk, Granitowa, registered in the register of ownership units of the Gdansk Housing Cooperative (Cooperative address: 80-152 Gdansk, ul. Powstancow Warszawskich 3) for which the III Department of Land and Mortgage Registers of the District Court Gdansk-North in Gdansk maintains the land and mortgage register number KW XXX.
The estimated value is
398,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to
298,500.00 PLN.
The bidder participating in the auction should submit a deposit by September 1, 2025, at 11:59 PM in the amount of one-tenth of the estimated value, which is 39,800.00 PLN.
The auction is conducted by electronic bidding and will end on
September 11, 2025 at 11:30 AM.
According to Article 986 with index 5 of the Code of Civil Procedure, the deposit must be submitted to the bank account of the court bailiff: Powszechna Kasa Oszczędności Bank Polski SA Branch 1 in Gdansk 80 10201811 0000 0702 0179 0864 no later than 2 business days before the auction starts, i.e., by September 1, 2025, at 11:59 PM. The date of deposit submission is considered the day the bailiff's bank account is credited.
Along with the deposit, the bidder is obliged to provide in the IT system the data necessary to issue a decision on the award: PESEL number, identity document number, and a statement whether they are married, and if so, whether the property is intended for joint or personal property, and to indicate whether they are bidding on their own behalf or as an attorney for another person, as well as other data if their submission is required by separate laws.
If necessary, the bailiff promptly calls the bidder, under the penalty of exclusion from participation in the auction, via the IT system to supplement the data, and if participation in the auction requires permission from a public authority or proof of authorization to act on behalf of another person - to submit electronically preserved copies of the required documents within 3 days, no later than the day before the auction date.
The bailiff confirms the fact of deposit submission and data provision immediately upon receipt, by allowing the bidder to participate in the auction. In case of refusal to allow participation in the auction, the interested party is notified via the IT system.
The auction starts and ends at the time indicated in the auction announcement.
During the auction, bidders offer the purchase price via the IT system. The auction is won by the bidder whose offer was the highest at the end of the auction.
After the auction ends, the bailiff informs the bidders via the IT system about the selection of the bidder offering the highest price at the end of the auction. A complaint against the refusal to allow participation in the auction can be submitted within 3 days from the date of refusal to allow participation in the auction, and against the course of the auction - within 3 days from the date of its conclusion. Bidders and persons who were not allowed to participate in the auction can submit a complaint only via the IT system. Other persons may also submit a complaint via the IT system if they have an account in that system.
According to Article 976 §1 of the Code of Civil Procedure, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who did not fulfill the conditions of the previous auction, persons who can acquire the property only with the permission of a public authority, and who did not present this permission.
In the last two weeks before the auction, the property can be viewed on weekdays from 10:00 AM to 3:00 PM. The protocol of description and valuation of the property is also made available in the IT system. The auction starts and ends at the time indicated in the auction announcement. If a bid is submitted within 5 minutes before the planned end of the auction, this time is extended by 5 minutes. If further bids are submitted during the additional time, the end time of the auction is extended by another 5 minutes until bidding ceases.

The rights of third parties will not hinder the auction and the awarding of ownership to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the property or items seized with it from execution and have obtained a ruling suspending the execution in this regard.
Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of execution and will expire upon the finalization of the decision on the awarding of ownership.
