NOTICE OF THE SECOND AUCTION OF THE PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Aleksandrow Kujawski announces to the public that in the case Km 43/18 on the date: 26.08.2025 at 13:30 the second auction will commence in the manner specified in Article 9864 § 4 of the Act of November 17, 1964, the Code of Civil Procedure (hereinafter: kpc) by electronic auction of the following properties:

- property located at ul. Wspólna, 87-731 Waganiec.

Property description:

Residential unit located at: 87-731 Waganiec, ul. Wspólna, Waganiec.

The estimated total is 62,700.00 PLN, while the starting price is equal to 2/3 of the estimated total and amounts to 41,800.00 PLN.

For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 08:00 to 15:00. The protocol of description and estimation is made available in the IT system.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated total, which is the amount of 6,270.00 PLN.

The sale is conducted by electronic auction. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as a proxy for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

According to Article 9864 § 2 kpc, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties will take place electronically and will end on: 02.09.2025 at 13:30. According to Article 9867po § 31 kpc, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not prevent the auction and the awarding to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the items from enforcement and have obtained a ruling suspending the enforcement in this regard.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the collection of documents and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

According to Article 976 kpc, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
