NOTICE OF THE FIRST AUCTION OF THE PROPERTY BY ELECTRONIC AUCTION

The Court Bailiff at the District Court in Goleniów, Bailiff's Office No. V in Nowogard announces to the public that in the case KM 233/25 on the date: 03.09.2025 at 12:00 the first auction in electronic mode will commence in accordance with the provisions of art. 9864 § 4 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC) of the following property:

- residential premises located at ul. Zaciszna, 72-200 Nowogard.

Property description:

The subject of the auction is a property located in Nowogard at Zaciszna Street with a usable area of 46.00 m2 along with a share of 215/10000 in the common parts of the building and in the land plot, covered by land and mortgage register KW No. 00044160.

The estimated value is 241,500.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 181,125.00 PLN.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 24,150.00 PLN.

The deposit must be submitted to the bailiff's bank account 19 2030 0045 1110 0000 0398 9470 no later than 2 working days before the auction starts.

The sale is conducted by electronic auction. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at the address elicytacje.komornik.pl and participating in the auction two working days before it starts. The bidder submits the deposit no later than 2 working days before the auction starts, and if participating in the auction as an attorney for another person, must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

Based on art. 9864 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system.

The auctions of the above-mentioned properties will take place electronically and will end on: 10.09.2025 at 12:00. Based on art. 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended each time by another 5 minutes until the bids cease.

The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, if these persons do not submit evidence that they have filed a lawsuit for the release of items from enforcement and have obtained a decision suspending enforcement before the auction starts.

Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.

According to art. 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, the bidder who has not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
