The Mayor of the City of Jozefow announces the first open oral auction for the sale of ownership rights to an unbuilt property located in Jozefow near Otwock. The subject of the sale is an unbuilt land property: Address (street) without a name. Property designation: Plot number 142, District number 17, Land use description Ls V, Land and mortgage register number WA1O/00092955/6. Area 1,504 m2. Purpose in the spatial development plan: The property is located in the area of the local spatial development plan approved by the Resolution of the City Council of Jozefow No. 69/IV/03 on May 9, 2003, regarding the approval of the change of the local spatial development plan of the city of Jozefow - stage III A, in the area marked with the symbol RLz 18 (forests with the possibility of single-family residential development). The starting price is net 1,300,000 PLN. Deposit 200,000 PLN. Note!! The paid deposit entitles participation only in the auction of the declared property. The sale price will be increased by the value-added tax (VAT) of 23%. The land plot 142 was geodetically separated from plots No. 83 and No. 84 from district 17 by virtue of the final decision of the Mayor of the City No. 65/2025 dated June 23, 2025. The division of plots has not been disclosed in the above-mentioned land and mortgage register. The property is not encumbered with entries in sections III and IV of the land and mortgage register, and there is no administrative proceeding regarding the correctness of its acquisition by the municipality. The unbuilt land property is not fenced and is covered with mixed tree growth, in the shape of a rectangle, located at an unnamed street - a road not classified as a category of municipal roads. The property has access to the municipal road Ejsmonda Street, managed by the Mayor of the City of Jozefow through plot number 92 in district 17 with the use 'road', which is owned by the municipality of the City of Jozefow, and managed by the Mayor of the City of Jozefow, and through plot number 141 in district 17 with the use 'LsV', which is owned by the municipality of the City of Jozefow. At the request of the Mayor of the City, proceedings are being conducted to exclude this plot from forest production. Ejsmonda Street has water supply, sanitary sewage, and energy networks. The unnamed street is unarmed. The surroundings of the property consist of forested and undeveloped areas. The property may have networks or protective zones of networks located on adjacent properties not disclosed by the managers, which the buyer must identify at their own expense. Any restrictions and difficulties in using the property or costs that may arise for the buyer from the existence of undisclosed networks are the buyer's risk and cannot be treated as defects of the property. The buyer is responsible for familiarizing themselves with the legal and factual state of the property and its current method of development, its parameters as well as the possibility of future development. Recognizing all factual and legal conditions necessary for the planned method of using the property by the buyer is entirely the buyer's responsibility and constitutes their risk. The communication service of the sold area must be agreed with the road manager, who issues consent for the construction of the driveway by administrative decision, in accordance with Article 29, paragraph 1 of the Act of March 21, 1985 on public roads. The construction of the driveway at the buyer's own expense, without the right to claims against the seller, is carried out by the buyer of the property. The buyer of the property, wishing to carry out construction on the property described above, is obliged to apply to the Regional Directorate of State Forests for its exclusion from forest production. According to the Act of March 11, 2016, amending the Act on forests, the State Treasury represented by the State Forests will have the right of first refusal regarding the property in question. The amount of the bid: the amount of the bid is determined by the auction participants, provided that the bid cannot be less than 1% of the starting price of the property. The auction will take place on September 19, 2025, at 1:45 PM at the seat of the City Hall of Jozefow at Cardinal Wyszynski Street 1, Building B - in the City Council Room of Jozefow (entrance from Parkowa Street). The condition for participation in the auction is the payment of the above-mentioned deposit by the deadline of September 15, 2025. The day of payment is considered the day the funds are credited to the bank account of the City Hall. The deposit should be paid in cash PLN, to the bank account of the Municipality of the City of Jozefow: Cooperative Bank in Karczew. The deposit is forfeited if the buyer selected in the auction withdraws from the contract. Bidders who did not win the auction will have their deposit returned immediately after the cancellation or closing of the auction, but no later than within 3 days from the date of cancellation, closing, invalidation, or negative result of the auction. The deadline for submitting an application by persons entitled to priority in acquiring the property under Article 34, paragraph 1, points 1 and 2 of the Act of August 21, 1997 on real estate management expired on June 18, 2025. Individuals and legal entities may participate in the auction. Auction participants are required to present the auction committee with documents enabling the determination of identity and ability to participate in the auction, in particular: entrepreneurs - submit proof of deposit payment, information from the Central Register and Information on Economic Activity or an excerpt from the National Court Register; spouses - present identity documents. Note!! When the community property regime applies in marriage and the funds intended for the acquisition of the property come from their joint property or when the community property regime applies to items acquired by either spouse, both spouses must personally participate in the auction or one spouse must have the appropriate power of attorney from the other spouse. If the acquisition is to take place in the personal property of the spouse, the spouse participating alone in the auction activities should present a document confirming the establishment of property separation or a written statement regarding the intention to acquire the property with funds from personal property. A foreigner (in the meaning of Article 1, paragraph 2 of the Act of March 24, 1920 on the acquisition of real estate by foreigners with amendments) must present a valid identity document and permission to acquire real estate issued by the minister responsible for internal affairs - if required. The buyer of the property determines at their own expense whether the acquisition of the property subject to the auction requires such permission. The buyer selected in the auction bears the notarial and court costs related to the transfer of ownership rights to the property. The seller is not responsible for hidden defects of the sold property, including those not disclosed in the County Geodetic and Cartographic Resource - the acquisition agreement will exclude the seller's liability for legal and factual defects in this regard. The buyer acquires the property in the legal and factual state described above. The auction organizer notifies the buyer of the place and date of the sale agreement no later than 21 days from the date of the auction resolution. The designated date cannot be shorter than 7 days from the date of delivery of the notification. The price of the property sold at auction must be paid no later than on the day of signing the ownership transfer agreement. On the day of signing the notarial agreement, the financial resources must be in the bank account of the City Hall of Jozefow.
