ANNOUNCES THE THIRD UNLIMITED ORAL AUCTION
for the sale of properties owned by the Municipality of Sztum

Description of the property
Unbuilt plot located in the vicinity of single-family residential buildings, with access to a hardened municipal road. The plot has a regular shape and is covered with grassy vegetation. The area of the plot is not fenced. Available utilities: electricity, water, gas.
Attractive location for residential functions, no environmental hazards.
Purpose of the property
For the area where plot no. 310 is located, no local spatial development plan has been adopted, however, according to the Study of Conditions and Directions of Spatial Development of the City and Municipality of Sztum, it is planned for development marked with the symbol Mu - areas of existing and projected extensive residential-service development.
No decision on development conditions has been issued for the plot.

Resolution of the City Council in Sztum IX.63.2024 dated October 30, 2024, regarding consent to sell plot no. 310 in the district 3 of the city of Sztum in the mode of unlimited auction.

Additional information
The buyer covers the costs of the notarial agreement and court costs.
Participants in the auction should familiarize themselves at their own expense with the condition of the property, including its parameters, current and possible future method of development. Recognizing all factual and legal conditions necessary for the planned investment is entirely the responsibility of the auction participant and constitutes an area of their risk.
The amount of the bid cannot be less than 1% of the starting price, rounded to the nearest tens of zlotys. The property subject to this auction is free from encumbrances and obligations. Furthermore, the Mayor of the City and Municipality ensures that no administrative or court proceedings are pending questioning the validity of the acquisition of the property by the Municipality of Sztum.
The deadline for submitting applications by persons entitled to priority in acquiring the property under Article 34, paragraph 1, points 1 and 2 of the Act of August 21, 1997 on real estate management expired after 6 weeks from the date of posting the list of the property intended for sale, i.e. 28.05.2025. No applications were submitted.
The auction will take place on September 29, 2025 (Monday) at 12:30 PM in the building of the City and Municipality Office of Sztum at Mickiewicza 39 (room no. 33).
The condition for participating in the auction is the payment of a deposit to the account of the City and Municipality Office in Sztum at the Cooperative Bank number 19 8309 0000 0000 0042 2000 0040, in such a way that no later than on the day of 25.09.2025 the deposit is in the bank account of the office. In the title of the transfer, please write "Auction - plot number, first name, last name, and PESEL of the person or name and NIP of the company for which the property will be acquired".
- The deposit paid by the participant who wins the auction is credited towards the purchase price of the property.
- The deposit is forfeited to the organizer of the auction if the participant who wins the auction withdraws from signing the notarial agreement.
- The deposit will be returned no later than within three days from the date of: cancellation of the auction, closing the auction, invalidation of the auction, ending with a negative result, not winning the auction.
Both legal entities and natural persons holding Polish citizenship or foreign persons (not having debts to the municipality of Sztum) who pay the deposit in the amount and time specified in the announcement may participate in the auction.
Auction participants are required to present to the auction committee:
- proof of deposit payment
- natural persons - identity document,
- if the participant in the auction is a legal entity, the person authorized to represent the participant should present a current excerpt from the National Court Register, and a person conducting business activity should present a certificate of entry in CEIDG,
- In the case where the participant in the auction is a person in a marriage:
- if the acquisition of the property is to take place in the joint property, the condition for admission to the auction will be the presence of both spouses at the auction or the submission of the consent of the other spouse in the form of a power of attorney specifying the type, subject, and essential conditions of the legal action concerned;
- if the acquisition of the property is to take place in the personal property, the condition for admission to the auction will be the submission of a notarial deed documenting the marital property agreement establishing separation of property or a copy of a court ruling establishing separation of property or a written statement of both spouses on acquiring the property in the personal property of one of them.
- In the case of a foreigner participating in the auction, in accordance with the Act on the acquisition of real estate by foreigners, the requirements resulting from this Act must be met;
- if the participant is represented by an attorney, it is necessary to present the original power of attorney authorizing action at every stage of the auction proceedings.
The price of the property determined through the auction is payable before the day of signing the sale agreement in the form of a notarial deed with appropriate advance notice so that the funds are in the bank account of the office before the agreement is concluded.
The date and place of the notarial agreement will be set within 21 days from the date of the auction resolution, of which the buyer will be notified no later than 7 days before the agreement date.
If the buyer of the property does not appear without justification to conclude the agreement at the place and time specified in the notification and does not sign the agreement, the deposit paid is not refundable.
The Mayor of the City and Municipality of Sztum reserves the right to cancel the auction for important reasons, promptly informing the public.
