Zwyciestwa Wojska Polskiego, 78-630 Czlopa, for which the District Court in Walcz V Department of Land and Mortgage Registers (address: ul. Sadowa 2, WALCZ, 78-600 Walcz) maintains a land and mortgage register number KO1W/000XXXXX/8. Description of the property: The subject of the auction is the ownership of real estate in the form of a plot numbered 18/2, with a total area of 1457 m2, built with a single-family residential building, detached and a utility building, located at 78-630 Czlopa ul. Zwyciestwa Wojska Polskiego, for which the District Court in Walcz V Department of Land and Mortgage Registers maintains a land and mortgage register number KW KO1W000XXXXX/8. The aforementioned property is inhabited. The estimated value is 301,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 225,750.00 PLN. Within two weeks before the auction, the aforementioned property can be viewed on weekdays from 10:00 AM to 12:00 PM. The protocol of description and valuation is made available in the IT system. The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is the amount of 30,100.00 PLN. Participation in the auction requires creating an account in the IT system servicing electronic auctions available at elicytacje.komornik.pl and joining the auction two business days before it starts. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place. According to art. 9864 § 2 CPC, the condition for participation in the auction is the creation of an individual account in the IT system. The auctions of the aforementioned properties are conducted electronically and will end on: 24.09.2025 at 12:00. According to art. 9867po § 31 CPC, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended each time by another 5 minutes until the bids cease. The rights of third parties will not prevent the auction and the award to the buyer without reservations, if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the items from enforcement and have obtained a judgment suspending the enforcement in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership. According to art. 976 CPC, the following cannot participate in the auction: the debtor, the bailiff, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a state authority, and who have not presented this permission.
