NOTICE OF SALE OF PROPERTY
BY ELECTRONIC AUCTION
The Judicial Officer at the District Court in Brodnica Jaroslaw Gardocki, announces to the public that
WE ARE WAITING FOR THE SECOND AUCTION DATE
the first electronic auction of the property will begin: a share of 1/2 of the property, namely:
plot No. 109/15 with an area of 0.0804 ha, on which there is a residential building with a usable area of 191.60 m2, located at: 87-300 Brodnica, Karbowo, St. Półwiejska, for which the District Court in Brodnica, Land and Mortgage Register Department, keeps the land and mortgage register with the number TO1B/000xxxxx/2.
The building is a single-family, two-story house with a usable attic, basement, built in 2012. Plot No. 109/15 does not formally have access to a public road. Functionally, access to the property is from the side of road plots No. 110 (owned by other individuals), 109/16 (owned by the municipality) with a partially dirt surface, about 150 m from the nearest asphalt road. According to the provisions of the Local Spatial Development Plan, plots No. 110 and 109/16 are designated as 02KDL - local public roads.
The owner of the subject property does not have a share in road plot No. 110, and the ownership of plot No. 110 has not yet been transferred to the Municipality. Therefore, legal access to the public road requires regulation.
Plot No. 109/16 belonging to the Municipality of Brodnica TOlB/000xxxxxx/4 was designated for the widening of plot No. 110. On 27.07.2021, the entry regarding the management of plot No. 110 by the Municipality of Brodnica was deleted from the land register according to the content of the entries in the land and mortgage register kept for property plot No. 110, which was private property. Access to the property is free. This change does not affect the value of the property.
Note! A discrepancy has been revealed regarding the use of the property, i.e., in the land and mortgage register, the plot is marked as R - arable land, while in the simplified extract from the land register, it is marked as B - residential areas, and a discrepancy regarding the ownership of the property; in the land and mortgage register, the owners have shares of 1/2 of the property, and in the land register, the owners are listed as a married couple. The sale by electronic auction is conducted through the IT system available at the address: elicytacje.komornik.pl.
The auction will end on ..................2025 at 09:00.
The property is valued at 337,500.00 PLN. The starting price is 2/3 of the estimated value, i.e., 225,000.00 PLN. The bidder participating in the auction should submit a deposit of 1/10 of the estimated amount, which is 33,750 PLN.
The property can be viewed in the two weeks before the auction from 10:00 to 18:00. Participation in the auction requires registration in the IT system supporting electronic auctions available at the address: elicytacje.komornik.pl at least 2 business days before the auction starts.
Participation in the auction requires creating an individual account in the IT system. The deposit must be paid to the judicial officer's bank account number: Cooperative Bank in Brodnica O. in Brodnica 12 94841150 0010 1332 2000 0001 no later than 2 business days before the auction starts. The date of the deposit is considered the day the judicial officer's bank account is credited. The provisions of Article 964 of the Code of Civil Procedure do not apply. Along with the deposit, the bidder is obliged to provide in the IT system the data necessary to issue a decision on the award: PESEL number, identity document number, and a statement on whether they are married, and if so, whether they intend to acquire the property for joint or personal property, as well as to indicate whether they are bidding in their own name or as a proxy for another person, and any other data if required by separate laws.
If necessary, the judicial officer promptly calls the bidder, under the penalty of exclusion from participation in the auction, via the IT system to complete the data, and if participation in the auction requires permission from a public authority or proving authorization to act on behalf of another person - to submit electronic copies of the required documents within 3 days, no later than the day before the auction date. The judicial officer confirms the submission of the deposit and data immediately after receiving them by allowing the bidder to participate in the auction. A notification of refusal to allow participation in the auction is sent to the interested party via the IT system.
The following cannot participate in the auction: the debtor, the judicial officer, their spouses, children, parents, and siblings, as well as persons present at the auction in an official capacity, bidders who have not fulfilled the conditions of the previous auction, persons who can acquire the property only with the permission of a public authority, and who have not presented this permission. The auction starts and ends at the time indicated in the notice of the auction of the property. If a bid is submitted within 5 minutes before the planned end of the auction, this time is extended by 5 minutes.
Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the award of ownership.
