ZAGAN DISTRICT BOARD acting on the basis of Article 38 and Article 40 paragraph 2a of the Act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145, as amended) in connection with the Act of April 11, 2003 on shaping the agricultural system (Journal of Laws 2024, item 423) announces the first limited oral auction for individual farmers for the sale of real estate owned by the Zagan District. Only individual farmers intending to expand their family farm, who have their place of residence in the commune where the property being auctioned is located or in a neighboring commune and meet the conditions specified in the further part of the announcement, may participate in the auction. I. SUBJECT OF SALE: Wiechlice district, Szprotawa commune, plot no. 336/9 with an area of 3.70 ha, marked with the use RV (arable land with an area of 2.19 ha) and PsVI (permanent pastures with an area of 1.51 ha). The property is undeveloped, unfenced, and unutilized. The area of the property is significantly wooded and bushy (self-seeded deciduous and coniferous trees). The property is located in the western part of Wiechlice, on the border with Henrykow. The immediate vicinity to the north (Henrykow) and south (Wiechlice) consists of land designated for industrial and service development. The shape of the plot is quite regular (a small number of bends). The plot is not equipped with utilities. An electricity network runs in the immediate vicinity of the property. In the area, there is a possibility of full utility connections (electricity, water, sewage, and gas). Access to the property is via a dirt road from Henrykow marked with plot no. 336/16. The property is sold based on data from the land and buildings register in accordance with the excerpt from the land registry map. There is no local spatial development plan; however, according to the "Study of conditions and directions of spatial development of the city and commune of Szprotawa" - Resolution No. VI/30/2024 of the City Council in Szprotawa dated July 26, 2024, the area of the plot in question is marked as a zone for the development of the dominant production and service function. The Zagan District Office has applied to the Municipal Office in Szprotawa to designate the plot in the general plan for residential and service areas. KW - ZG1G/00062719/3 - no encumbrances and obligations for the sold plot. The starting price of the property is 3,650,000.00 PLN (in words: three million six hundred fifty thousand 00/100 zlotys). The deposit is 200,000.00 PLN (in words: two hundred thousand 00/100 zlotys) by October 1, 2025, and by that date it should be in the account of the Zagan District Office - PKO Bank Polski S.A. 96 1020 5402 0000 0602 0336 8206. The auction will take place on October 10, 2025, at the headquarters of the Zagan District Office (68-100) at Dworcowa Street 39, room 100 (1st floor) at 11:00 AM. II. PERSONS WHO CAN PARTICIPATE IN THE AUCTION: Only individual farmers may participate in the auction if they have a place of residence in the commune where the property being auctioned is located or in a neighboring commune, meeting the conditions specified in the Act of April 11, 2003 on shaping the agricultural system (UKUR) (Journal of Laws of 2024, item 423), i.e., individuals who are individual farmers within the meaning of Article 6 UKUR, i.e., individuals who meet the following conditions: 1) They are owners, perpetual usufructuaries, self-possessors, or tenants of agricultural properties, whose total area of agricultural land - including the area of agricultural land included in the property being auctioned - does not exceed 300 ha, have agricultural qualifications, and have resided for at least 5 years in the commune where one of the agricultural properties included in the agricultural farm is located and have personally conducted that farm during that period. The period referred to in paragraph 1 includes the period of residence in another commune immediately preceding the change of residence if one of the agricultural properties included in the agricultural farm referred to in paragraph 1 was located in that commune. 2) It is considered that an individual physically conducts an agricultural farm if: a) they work in that farm, b) they make all decisions regarding agricultural activities in that farm; 3) They have agricultural qualifications (according to Appendix No. 3) if: a) they have obtained agricultural vocational education, basic vocational, secondary, secondary vocational, or higher education, or b) they have obtained a qualification title or professional title or master title in a profession useful for conducting agricultural activities, or c) they have obtained higher education other than agricultural and have at least 3 years of work experience in agriculture or higher education other than agricultural and completed postgraduate studies related to agriculture, or secondary or secondary vocational education other than agricultural and have at least 3 years of work experience in agriculture, or d) they have at least 5 years of work experience in agriculture, which is considered the period in which the individual: - was subject to social insurance for farmers or - conducted agricultural activities in an agricultural farm with an area of at least 1 ha owned by them, subject to perpetual usufruct, self-possessed, or leased, or - was employed in an agricultural farm under an employment contract or cooperative employment contract, performing work related to conducting agricultural activities, or - performed work related to conducting agricultural activities as a member of an agricultural production cooperative, or - completed an internship referred to in Articles 114 and 119 of the Act of March 20, 2025 on the labor market and employment services (Journal of Laws, item 620), covering activities related to conducting agricultural activities. Work experience also includes the period of work in an individual agricultural farm confirmed by a certificate issued under the provisions of the Act of July 20, 1990, on counting periods of work in an individual agricultural farm towards employee work experience (Journal of Laws, item 310). III. CONDITIONS FOR QUALIFICATION TO PARTICIPATE IN THE AUCTION: The condition for qualification to participate in the auction is the submission by the interested person, no later than October 1, 2025, at 3:00 PM at the headquarters of the Zagan District Office (68-100) at Dworcowa Street 39, in a sealed envelope marked "Qualification of participants for the auction for the sale of plot no. 336/9 Szprotawa" of the following documents: - a statement according to template No. 1, acknowledging the subject of the auction, the content of the auction announcement - statements of personally conducting an agricultural farm and the total area of agricultural land owned, under perpetual usufruct, and self-possessed, as well as leased by the individual farmer [according to template No. 2], - a statement of having agricultural qualifications, along with copies of documents confirming these qualifications [according to template No. 3], - in the case of a person who has conducted a farm for more than 5 years - only documents confirming at least 5 years of work experience in agriculture, and in the absence of the possibility of confirming the experience according to the above provisions - copies of documents confirming agricultural qualifications, - a document confirming permanent residence (minimum 5 years) within the meaning of the provisions on population registration and identity cards (a certificate issued by the commune is valid for 2 months from the date of issue, unless there has been a change of residence). The 5-year period of residence referred to above includes the period of residence in another commune immediately preceding the change of residence if one of the agricultural properties included in the agricultural farm was located in that commune. Templates of the aforementioned statements are available at the Department of Geodesy, Cartography, Cadastre, and Real Estate of the Zagan District Office at Jana Pawla II Street (68-100 Zagan) room 105-106 and also on the website as an attachment to the auction announcement. The person submitting the statement is obliged to include in it the clause of the following content: "I am aware of the criminal liability for submitting a false statement." This clause replaces the authority's instruction on criminal liability for false testimony. The auction announcement will be posted on the notice board of the Zagan District Office, on the website; and on internet portals regarding real estate. Persons may participate in the auction if they meet the requirements specified in the announcement and pay the deposit within the time specified in the auction announcement and present an identity document that will identify the person or appropriate power of attorney authorizing action on behalf of that person. According to Article 37 of the Act of February 25, 1964, the Family and Guardianship Code (Journal of Laws 2020.1359, consolidated text), to perform a legal act leading to the sale, encumbrance, paid acquisition, or perpetual usufruct of real estate, the consent of the other spouse is required in the case of statutory community. The validity of the agreement made by one of the spouses without the required consent of the other depends on the confirmation of the agreement by the other spouse. The lack of consent from one of the spouses when concluding the notarial deed will result in the forfeiture of the deposited deposit, and the auction will be considered void. Entities that are foreigners must demonstrate the appropriate permit issued under the provisions of the Act of March 24, 1920, on the acquisition of real estate by foreigners. When determining the area of agricultural land included in the family farm of the individual farmer and being the subject of co-ownership, the area of agricultural properties corresponding to the share in the co-ownership of such properties is taken into account, and in the case of joint ownership, the total area of agricultural properties subject to co-ownership is taken into account. This principle is also applied to determine the area of land subject to self-possession, perpetual usufruct, or lease. Agricultural land includes: arable land, orchards, permanent meadows, permanent pastures, built agricultural land, land under ponds, land under ditches. The list of persons qualified for the auction and those who have not submitted all required documents with an indication of missing documents will be published on the entity's website in the Public Information Bulletin and posted on the notice board at the headquarters of the Zagan District Office (68-100) at Dworcowa Street 39 and Jana Pawla II Street 9 on October 3, 2025, by 3:00 PM and published on the website as an attachment to the auction. Persons who have not submitted all required documents necessary for qualification to participate in the auction will have the opportunity to supplement the missing documents if they submit the missing documents no later than October 6, 2025, by 3:00 PM at the headquarters of the Zagan District Office (68-100) at Dworcowa Street 39 in a sealed envelope marked: "Missing documents for the limited auction for the sale of agricultural property, 336/9 Szprotawa." Persons who do not submit the required documents by the above-mentioned deadline and place will not be allowed to participate in the auction. The final list of persons qualified for the auction will be posted on the entity's website in the Public Information Bulletin and on the notice board at the headquarters of the Zagan District Office on October 9, 2025, by 3:00 PM and published on the website as an attachment to the auction. The auction will take place if at least one person qualified for the auction meets the conditions specified in the announcement. IV. CONDITIONS FOR PARTICIPATION IN THE AUCTION: 1) Persons qualified for the auction may participate in the auction if they pay the deposit in the required amount within the time and place specified in the announcement. 2) Persons participating in the auction should familiarize themselves with the legal status and boundaries of the property being auctioned. 3) Auction participants are obliged to present the Auction Committee with a document confirming identity and citizenship if the participant is an individual. 4) Representatives of auction participants must present the appropriate powers of attorney to the Auction Committee. 5) A deposit payment receipt must be available. 6) Auction participants are obliged to submit a statement acknowledging familiarity with the property on-site and a statement acknowledging familiarity with the content of the announcement and accepting it without reservations. 7) The auction is conducted if at least one auction participant appears. The deposit is non-refundable: 2) to the auction participant who wins the auction and withdraws from concluding the agreement, 3) if the conclusion of the agreement becomes impossible for reasons attributable to the auction participant. The right to withdraw from the sale agreement with the candidate buyer determined as a result of the auction is reserved in the event that on the day the sale agreement is to be concluded, the land included in their agricultural farm along with the land being sold exceeds the area of 300 ha of agricultural land. In the event of withdrawal from the conclusion of the agreement, the deposit paid before the auction will be forfeited for reasons attributable to the auction participant. The property is sold based on data from the land and buildings register in accordance with the excerpt from the land registry map. In the event of a possible boundary renewal carried out at the buyer's cost and effort, the Zagan District is not responsible for any discrepancies. The buyer will be obliged to submit a statement that they are aware of the factual state of the property offered for sale, its area, boundary course, access, type of use, and will not make claims against the Zagan District in the event that the boundary renewal carried out by the surveyor shows changes compared to the data from the land register on the day of its sale. The costs associated with concluding the sale agreement and court fees are borne by the buyer. The auction price must be paid in such a way that the required amount is in the account of the Zagan District Office by the day before the conclusion of the notarial agreement. The price of the property does not include the costs of renewing the boundary markers of the plot within which the property is located. In the event of a need to show the boundaries, the buyer will establish the conditions for this with the surveyor of their choice. The showing of boundaries will take place at the buyer's expense.
