WRITTEN OFFER COMPETITION: The syndic of the bankruptcy estate in the bankruptcy proceedings involving the liquidation of the assets of Monika Magierowska ("Debtor") announces a written offer competition for the sale of the ownership rights to the real estate consisting of a separate residential unit number 3 located in Krakow at ul. Mikołajska 11, covered by land and mortgage register number KR1P/00365589/3, (hereinafter referred to as: "Property"), at a price not lower than 916,000.00 PLN (in words: nine hundred sixteen thousand zlotys), constituting 100% of the market value estimated by the expert appraiser Magdalena Slufarska in the valuation report dated 09.06.2023. The condition for participation in the written offer competition is: Preparation of an offer, which must be packed in a sealed envelope marked "Monika Magierowska - competition offer - case file: VIII GUp 140/20/S" and with the note "DO NOT OPEN" and delivered to the Notary Office Tomasz Kunicki, Mateusz Olszewski, Notary Office s.c. in Krakow, ul. Krolewska 23/1, 30-040 Krakow, during the Notary Office's working hours from the date 28.08.2025 to the date 12.09.2025, with the date of submission of the offer, also sent by mail, being considered the date of its receipt at the Notary Office. Payment of a deposit in the amount of 10% of the starting price, i.e. the amount of 91,600.00 PLN to the bank account 41 1910 1048 2103 0081 1651 0001 by the date 12.09.2025. The purchase offer should include: exact identification of the offeror: in the case of individuals: first and last name, residential address of the offeror, PESEL number and NIP of the offeror, contact phone number, optionally email address; in the case of entrepreneurs: indication of the offeror's company, registered address of the offeror, legal form of the offeror, REGON and NIP number, and in the case of entities registered in KRS - KRS number, contact phone number, optionally email address, current excerpt from the relevant register of the offeror, proposed purchase price of the Property, statement of the offeror's acquaintance with the legal and technical condition of the Property, statement that the offeror is not a person indicated in art. 157a sec. 2 and 3 of the bankruptcy law, i.e. is not a syndic, his spouse, ascendant, descendant, sibling, person related to him by adoption or spouse of such a person, as well as a person living with him in a common household, statement that the offeror is not bankrupt, is not a representative of the bankrupt, commitment of the offeror to cover all costs related to the transfer of the Property, all permits and consents, including corporate consents, if required by law due to the person or company of the buyer, in the case of acting through a proxy, the original power of attorney document in the form of a notarial deed to represent the offeror in the offer competition, handwritten signature of the individual being the offeror or signatures of persons authorized to represent the offeror who is not an individual on the offer and on all statements, statement of the offeror being an individual [NOTE: this also applies to individuals intending to purchase the subject of the offer competition as part of running a sole proprietorship], whether they are married, and if so, whether they are acquiring the subject of the offer competition for personal property or for the joint property of spouses, whereby: in the case of acquiring the subject of the offer competition for personal property, the offeror should submit a relevant statement with the offer; in the case of acquiring the subject of the offer competition for the joint property of spouses, the offer may be submitted by one of them, however, in accordance with art. 37 § 1 point 1 of the Act of February 25, 1964 - Family and Guardianship Code, the consent of the other spouse is required in such a case. The consent of the other spouse to acquire the subject of the offer competition for joint property must be expressed in the form of a notarial deed and must include consent to acquire the subject of the offer competition, submit the offer and participate in the offer competition, statement of the offeror to have read the regulations and accept the terms and conditions of the competition. The evaluation of offers will take place at the Notary Office Tomasz Kunicki, Mateusz Olszewski, Notary Office s.c. in Krakow, ul. Krolewska 23/1, 30-040 Krakow on the date 15.09.2025 at 10:00. All information about the competition is provided by email at the email address: office @ and by phone at the phone number 512 one hundred eighty-five 195 during the hours from 10:00-14:00. The deposit submitted by offerors whose offers are not accepted will be returned within fourteen days from the date of selection of the offer; the deposit submitted by the buyer will be credited towards the purchase price; if the offeror whose offer is accepted withdraws from concluding the contract within the time specified by the Organizer of the Competition, the deposit is forfeited in favor of the seller; if the offeror submits false data in the purchase offer, the offeror loses the submitted deposit; the Organizer of the Competition may withdraw from the auction or invalidate the auction without giving reasons; the Organizer of the Competition may withdraw from signing the sale agreement if there are grounds for it. The buyer is obliged to cover all costs related to the transfer of the rights to the Property.
