The Syndic of the Bankruptcy Estate in the bankruptcy proceedings marked with the case number RZ1Z/GUp/43/2023 invites bids for the purchase of a partially developed land property with a brick residential building, single-story with usable attic, partially basemented with a building area of 98 m2, and a utility-garage building with a building area of 60 m2. The property is located in the town of Turbia. Auction conditions: 1. The subject of the auction is a land property partially developed, consisting of land plots with numbers: 1669/1; 1670/1; 1674/1 and 1175, for which the District Court in Stalowa Wola maintains a land and mortgage register with the number TB1S/00018854/0; 2. The starting price of the auction item is the amount of 552,000.00 PLN (in words: five hundred fifty-two thousand zlotys zero groszy) net, which will be increased by the appropriate tax; 3. An unlimited circle of entities may participate in the auction; 4. Participants in the auction have the opportunity to inspect the auction item after prior arrangement with the syndic; 5. Payments that do not meet the above requirements will not be considered effectively made deposits, which will mean the inability to participate in the auction; 2) submission of a written offer in a sealed envelope marked "Auction - RZ1Z/GUp/43/2023 - do not open", at the syndic's office at Al. Jana Pawła II 25/217, 37-450 Stalowa Wola, within four weeks from the date of publication of the invitation to submit bids on this website, on business days from 8:00 AM to 6:00 PM (actual receipt at the syndic's office). 7. Each offer must include: 1) exact identification of the bidder, i.e.: a) in the case of a natural person not conducting business activity: name and surname, residential address, PESEL number, b) in the case of an entrepreneur being a natural person: name and surname, the company under which the business activity is conducted and the address of the place of conducting this business activity, as well as the NIP of this person, c) in the case of an entrepreneur other than a natural person: specification of the legal form of the bidder, indication of the company, registered office and address of the bidder, number in KRS and NIP, 2) written statements of the bidder that: a) there are no reasons, as referred to in the provisions of the Act of February 28, 2003, Bankruptcy Law, excluding the possibility of acquiring by the bidder things or rights in the bankruptcy proceedings conducted against the Debtor, b) the bidder has familiarized themselves with the legal and technical states of the Auction Item and accepts them without reservations; c) in the event of the selection of the bidder's offer, the bidder undertakes to pay the offered price, as well as to cover all taxes, fees, and costs related to the sale of the Auction Item, d) the bidder has familiarized themselves with the sales conditions and accepts them without reservations; e) the bidder agrees to exclude liability for physical and legal defects of the Auction Item; f) the bidder agrees to the processing of personal data in the scope of data disclosed in the offer for the purpose of preparing and concluding the sales contract for the Auction Item on these sales conditions; g) the bidder, before submitting the offer, has been instructed by the Syndic about the provisions of the Act of April 23, 1964, Civil Code, the Act of April 11, 2003, on shaping the agricultural system, and the provisions of the Act of February 28, 2003, Bankruptcy Law, and that they understood their content and do not raise any comments or reservations in this regard, h) the submitted offer is unconditional and irrevocable; 3) indication of the offered sale price of the Auction Item, provided that the offered sale price must be expressed both numerically and in words and cannot be lower than the minimum price of the Auction Item, i.e. it cannot be lower than 552,000.00 PLN (in words: five hundred fifty-two thousand zlotys zero groszy) net. In the event of discrepancies between the value expressed numerically and the value expressed in words, the price expressed in words shall prevail. 4) a legible signature of the bidder being a natural person or legible signatures of persons authorized to represent the bidder who is not a natural person. The Syndic reserves the right to change the auction conditions and to cancel the auction at any stage of its conduct without giving reasons.
