based on the act of August 21, 1997 on real estate management (Journal of Laws of 2024, item 1145)

with amendments, the regulation of the Council of Ministers of September 14, 2004 on the method and procedure for conducting tenders and negotiations for the sale of real estate (Journal of Laws of 2021, item 2213 with amendments) and Order No. 121/2025 of the Mayor of Szczawno-Zdroj of July 14, 2025 regarding the designation for sale by way of an unlimited tender of undeveloped land located in Szczawno-Zdroj at

Szczawinska Street, consisting of plots marked with numbers 9/2 and 10/9 with a total area of 2.6280 ha in the Szczawno-Zdroj 1 precinct.

ANNOUNCES

the first oral unlimited tender for the sale of undeveloped land located in Szczawno-Zdroj at Szczawinska Street, marked in the land registry as plots:

-number 9/2 with an area of 1.3622 ha (arable land: RIIIa – 0.6356 ha, RIIIb – 0.1999 ha, RIVa – 0.5267 ha),

-number 10/9 with an area of 1.2658 ha (arable land RIVa – 0.0893 ha, permanent meadows ŁIII – 1.1577 ha, urbanized undeveloped or under construction areas Bp – 0.0188 ha),

for which the District Court in Walbrzych, VII Land and Mortgage Register Department keeps the land and mortgage register

number SW1W/00059129/7.

Starting price of the property: 2,900,000 PLN + VAT 23%

The tender will take place on

November 7, 2025, at 12:00 PM,

in room 27 of the City Hall of Szczawno-Zdroj at T. Kosciuszko Street 17.

Participation in the tender requires the payment of a deposit in cash of 150,000 PLN (one hundred fifty thousand zlotys) to the account of the Health Resort Municipality of Szczawno-Zdroj -

PKO BP SA O/Walbrzych No. 76 1020 5095 0000 5102 0011 4264. The deposit paid in cash must be credited to the municipality's account no later than on October 31, 2025. In the payment title (transfer), please write - "deposit - plot number 9/2 and 10/9".

Additional notes:

  • the amount of the bid increase is determined by the tender participants, provided that the increase cannot be less than 1% of the starting price, i.e. 29,000 PLN (in words: twenty-nine thousand zlotys). The tender will be valid regardless of the number of participants if at least one participant offers a price higher than the starting price by at least one increase. Tender participants announce subsequent price increases orally until, despite three calls, there are no further increases.
  • the deposit paid by the participant who wins the tender will be credited towards the purchase price
  • of the property,
  • the deposit paid by the other tender participants will be returned no later than within 3 days from the date of the tender,
  • the date of signing the notarial agreement regarding the sale of the property will be established within
  • 21 days from the date of the tender,
  • the purchase price of the property must be paid in full no later than on the day of signing
  • the notarial deed,
  • all costs of preparing the agreement in the form of a notarial deed, court fees are borne by
  • the buyer,
  • if the entity designated as the buyer does not appear without justification at the designated time at the notary's office, the Mayor of Szczawno-Zdroj may withdraw from the conclusion of the notarial agreement, and the paid deposit is non-refundable.
  • tender participants are required to have:

- an identity document (the electronic form of the identity card constitutes a document confirming identity);

- confirmation of the deposit payment;

- a current printout from the National Court Register or from another relevant register for entities other than natural persons, NIP number;

- an excerpt from the relevant register translated by a sworn translator, all documents mentioned in this point should be in written form (paper).

  • individuals and legal entities as well as foreigners may participate in the tender under the rules specified in the act of March 24, 1920 on the acquisition of real estate by foreigners (Journal of Laws.
  • of 2017, item 2278),
  • foreigners (within the meaning of the act of March 24, 1920 on the acquisition of real estate by foreigners), in the event of winning the tender are obliged to obtain the consent of the Minister of the Interior and Administration for the acquisition of real estate in cases where such consent is required,
  • interested parties may participate in the tender in person or through representatives who have the appropriate power of attorney to perform legal actions,
  • the sale of the property is subject to the applicable VAT rate based on Article 41, paragraph 1, in connection with Article 146aa point 1 of the act of March 11, 2004 on the tax on goods
  • and services (Journal of Laws of 2025, item 775, as amended). The VAT rate on the day of the tender announcement is 23%. VAT will be added to the price determined in the tender,
  • in section III of the land and mortgage register, kept for the property, there is an entry of a limited property right related to another property. The content of the right: free land easement in favor of the current owner of plot number 10/8, covered by land and mortgage register number SW1W/00086709/5, consisting of the right of passage and transit through plots number 10/9, 9/2, 8/2, 5/2, 7/2 covered by land and mortgage register number SW1W/00059129/7 with the course marked on the map attached to the sale agreement of February 11, 2013, Rep. A No. 2796/013. Subject of execution: plots number 10/9, number 9/2, number 8/2, number 5/2, number 7/2. Plot 7/3 was created from the division of plot number 7/2, and plot number 5/3 from the division of plot 5/2.
