NOTICE OF THE FIRST AUCTION OF THE PROPERTY

IN THE COURSE OF ELECTRONIC AUCTION

Court Bailiff at the District Court in Lubin Maciej Kowalczyk based on Article 953 of the Code of Civil Procedure announces to the public that in case KM 1734/18 and others

on the day 27-06-2024 at 11:00

the auction will commence in the manner established in Article 986 §4 of the Code of Civil Procedure

the first auction in electronic mode

of the property constituting plot number 100/7 in perpetual usufruct until 05.12.2089 with an area of 0.4772 ha, built with an industrial building with a total area of 1534 m2, located in the Koźlice district 59-305 Rudna, for which the Land and Mortgage Register Department of the District Court in Lubin maintains the land and mortgage register number KW LE1U/000xxxxx/9.

The estimated value is 475,000.00 PLN, while the starting price is equal to 3/4 of the estimated value and amounts to 356,250.00 PLN.

The bidder participating in the auction should submit a deposit of one-tenth of the estimated value, which is 47,500.00 PLN. The deposit must be submitted to the bailiff's bank account PKO BP S.A. I O in Legnica 11 1020 3017 0000 2102 0157 5513 no later than 2 business days before the auction (in the title, please write "deposit for case Km 1734/18 and others").

For two weeks before the auction, the above-mentioned property can be viewed on weekdays from 8:00 AM to 6:00 PM. The protocol of description and valuation is made available in the IT system.

Based on Article 986 § 2 of the Code of Civil Procedure, a condition for participation in the auction is the creation of an individual account in the IT system servicing electronic auctions available at / and participation in the auction two business days before its commencement. The bidder submits the deposit no later than 2 business days before the auction starts, and if participating in the auction as an attorney for another person, they must additionally present their authorization. The participation of one bidder is sufficient for the auction to take place.

The auction of the above-mentioned property takes place in electronic mode and will end on 04.07.2024 at 11:00.

Based on Article 9867§31 of the Code of Civil Procedure, if a bid is submitted within 5 minutes before the planned end of the auction, this deadline is extended by 5 minutes. If further bids are submitted during the additional time, the end of the auction is extended by another 5 minutes each time until the bids cease.

The rights of third parties will not hinder the auction and the awarding to the buyer without reservations, provided that these persons do not submit proof before the auction starts that they have filed a lawsuit to release the items from enforcement and have obtained a judgment suspending the enforcement. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of enforcement and will expire upon the finalization of the decision on the awarding of ownership.
