NOTICE OF THE SECOND AUCTION OF REAL ESTATE IN A SIMPLIFIED EXECUTION PROCEDURE
The Court Bailiff at the District Court in Lubin, Konrad Klemaszewski, announces to the public that

at the bailiff's office located at: Lubin, Armii Krajowej 14A will begin in the manner established in Article 1013® in conjunction with Article 867 of the Act of November 17, 1964, Civil Procedure Code (hereinafter: CPC),
THE SECOND auction of the following real estate
located at: 59-140 Chocianow, Glogowska Street, for which the District Court in Lubin, Division V of Land and Mortgage Registers maintains the land and mortgage register number LE1U/000xxxxx/1.
The subject of the auction is the property located in the Lower Silesian Voivodeship, Polkowice County, in the town of Chocianow at Glogowska Street.
The property includes plot no. 526/2 with an area of 3,170 m2, land use description: B - residential areas. The property is located in an area marked with the symbol 15MWn - establishing the following purpose: area for low multi-family residential development.
The property is located in the northern part of the town of Chocianow on its outskirts. The access road is directly a public provincial road marked no. 331 as an asphalt road which is Glogowska Street.
The access road is directly a public road property - provincial road, marked with geodetic number 508/1. This road is paved with bituminous surface, in good condition, two-way road, no permission for access. A road easement has been established for the property with an entry in the land and mortgage register, consisting of the right of passage and crossing through plots no. 526/1 and 525, which have an arranged access from the provincial road. The area of the property contains construction waste along with gravel. The plot area is undeveloped, covered with low vegetation of a segetal nature and self-seeding trees.
The property KW LE1U/000xxxx/1 is valued at the amount of 550,179.00 PLN gross. The starting price is 2/3 of the estimated value, i.e. the amount of 366,786.00 PLN gross.
The property can be viewed within two weeks before the auction from 08:00 to 18:00. The valuation report and the description and valuation protocol can be reviewed at the bailiff's office from Monday to Thursday from 08:00 to 15:00
Participants in the auction are required to submit a deposit of one-tenth of the estimated amount, i.e. the amount of 55,017.90 PLN, no later than the day before the auction. The deposit should be paid to the bailiff's bank account number: Bank Millennium SA Millennium - Settlement Center 22116022020000000146873928 or in cash at the bailiff's office. The deposit submitted by the bidder who was awarded the bid is retained; the remaining bidders will have their deposits returned immediately. If the buyer does not fulfill the auction payment conditions on time, they lose the deposit, and the effects of the bid expire. The lost deposit covers the execution costs related to the sale, and the remainder is included in the sum obtained in the execution or, if the execution has been discontinued, is transferred to the income of the State Treasury. The deposit is not submitted by the creditor participating in the auction, who has a claim of value not lower than the amount of the deposit and if to this amount their claim and rights benefiting from priority before this claim have coverage in the starting price.
In the auction, the following cannot participate: the debtor, the bailiff, their spouses, children, parents, and siblings, persons present at the auction in an official capacity, and a bidder who has not fulfilled the conditions of the previous auction. The presence of one bidder is sufficient for the auction to take place. The power of attorney to participate in the auction should be confirmed by a document with an officially certified signature, unless it concerns a power of attorney granted to a lawyer or legal advisor.
The buyer is obliged to pay the purchase price immediately after being awarded the bid. However, if the purchase price exceeds five hundred PLN, the buyer's obligation is limited to immediately depositing one-fifth of the price, but not less than five hundred PLN, with the remainder of the price, which includes the deposited deposit, being paid the next day during the working hours of the bailiff's office or to the bailiff's bank account by 18:00 the next day. If this day falls on a Saturday or a public holiday, the price is paid on the next day after the day or days off.
If the buyer does not pay the amount due immediately upon being awarded the bid, the bailiff will promptly resume the auction of the same properties, starting from the starting price, with the slow buyer not being able to participate in the auction. If the remainder of the price payable the day after the auction is not paid on time, a new auction will be scheduled under the conditions of the first. From the buyer exempted from the obligation to pay the deposit, who has not fulfilled the obligation to pay the price or its part within the prescribed time, the bailiff collects an amount corresponding to one-tenth of the estimated amount. The amount collected from the buyer covers the costs related to the auction. The surplus should be paid to the court cash register for the benefit of the State Treasury.
The rights of third parties will not hinder the auction and the award to the buyer without reservations if these persons do not submit proof before the auction starts that they have filed a lawsuit to exempt the property or items seized with it from execution and have obtained a judgment suspending the execution in this regard. Usufruct, easements, and lifetime rights, if not disclosed in the land and mortgage register or by submitting a document to the document collection and not reported no later than three days before the auction starts, will not be taken into account in the further course of the execution and will expire upon the finalization of the decision on the award of ownership. Based on Article 954 point 2 of the CPC, the bailiff calls on the relevant authorities to report the summary of taxes and other public dues due by the day of the auction no later than the auction date.
