REGULATIONS SALE BY FREE HAND SHARE 1/2 IN RESIDENTIAL BUILDING ("REGULATIONS") §1 1. This sale by free hand is conducted in connection with the ongoing proceedings before the District Court for Krakow - Srodmiescie in Krakow, VIII Economic Division for bankruptcy and restructuring cases regarding the bankruptcy of Bogdan Ladokha - a natural person not conducting business activity. The sale is conducted by Maciej Strosznajder - the syndic of the bankruptcy estate no. lic. 629. 2. The sale of the property is based on the Act of February 28, 2003 Bankruptcy Law (hereinafter referred to as "BL") and the Act of April 23, 1964 - Civil Code (hereinafter referred to as "CC"). The sale conducted in bankruptcy proceedings has the effects of enforcement sale (art. 313 sec. 1 BL). 3. The bankruptcy proceedings are conducted based on the IT system known as the National Register of Debtors. 4. Procedural letters and documents containing classified information within the meaning of the Act of August 5, 2010 on the protection of classified information (Journal of Laws of 2019, item 742, as amended), as well as offers submitted during the tender or auction are submitted without the use of the IT system servicing the court proceedings (art. 216ab BL). §2 1. The subject of the sale is a 1/2 share in the ownership of the real estate plot 404/8 with an area of 0.0345 ha built with a single-family residential building no. 16 with a usable area of 148.25 m2 located at ul. Spacerowa in Bolencin (voivodeship of Malopolskie, municipality of Trzebinia) registered in the land and mortgage register no. KR1C/00073136/6, detailed in the valuation report determining the market value of the ownership right to the property. 2. The property is inhabited by the bankrupt. 3. The starting price of the subject of sale (1/2 share) is 169,229.70 PLN. 4. The condition of the property can be reviewed after prior telephone arrangement with the syndic. §3 1. Offers should be submitted in paper form to the syndic's office by 15:00 on September 22, 2025. 2. Offers sent by mail are considered submitted on time if they arrive at the Office by 15:00 on September 22, 2025. 3. Offers should be submitted in sealed envelopes with the note "Offer to purchase a share in the property in bankruptcy proceedings KR1S/GUp/41/2024" 4. Interested parties wishing to receive the full regulations and valuation report are requested to contact the syndic's office via email and phone number: 502 482 666. 5. The opening of offers will take place the day after the deadline for submitting offers, i.e. on September 23, 2025, at 15:30 at the office of the syndic Maciej Strosznajder (ul. Gen. Tadeusz Kosciuszko 36a, 32-500 Chrzanow). §4 1. Each offer must include: a) exact identification of the offeror (first and last name or full name indicating the legal form, address of residence or registered office); b) identification of the person representing the offeror and their phone number; c) proposed purchase price, which cannot be lower than the starting price; d) a statement that the offeror has read the sales regulations, meets the conditions specified in these regulations, and accepts the content of the regulations; e) a statement that the offeror undertakes to cover all costs related to the purchase; f) a statement that the offeror has familiarized themselves with the current legal status of the property and does not raise any objections in this regard; g) handwritten signature. 2. The offer must be accompanied by: a) an excerpt from the relevant register or records (in the case of entrepreneurs); b) the required permission from the company's authorities to acquire the subject of the sale according to the Commercial Companies Code; c) a document confirming the authority of the person signing the offer to represent the offeror. §5 1. A condition for participation in the tender is the payment of a deposit of 10% of the sale price, i.e. 16,922.97 PLN. 2. The deposit must be paid by bank transfer to the account number: 08 1140 2004 0000 3702 8219 1500 with the title "Deposit - case no. KR1S/GUp/41/2024" no later than the last day of the deadline for submitting offers, with the actual date of recognition of the amount of the deposit on the above-mentioned bank account being counted. 3. In the case of later selection of the offer, the paid deposit will be credited towards the price. 4. If the offer is not selected, the deposit will be returned to the account from which the funds were transferred within 7 days from the date of opening the offers. §6 1. Detailed information regarding the sale is provided to interested parties by the syndic at the email address and phone number: 502 482 666. §7 1. The selection of the offer is made by the syndic based on the price criterion. 2. The offeror whose offer is accepted will be notified immediately of the selection. 3. Offers that do not meet the requirements of these Regulations and offers that are illegible or incomprehensible will not be recognized. §8 1. The syndic selects the offer with the highest price. 2. If two or more identical offers meeting the conditions of these Regulations are submitted, the syndic invites the offerors to submit further offers, setting a deadline not longer than 14 days until the selection of the most advantageous offer. 3. If the highest offer is not selected, the syndic will cancel the proceedings and publish another announcement regarding the sale. §9 1. The offeror whose offer is selected is obliged to pay the purchase price reduced by the amount of the deposit no later than on the day of concluding the property transfer agreement. Payment on time is considered to be the receipt of funds in the account indicated by the syndic. The funds must be credited to the account before the notarial deed is concluded. 2. The sale agreement will be signed after the full price is paid by the offeror. 3. The sale agreement will be concluded in the form of a notarial deed before a notary chosen by the syndic. 4. All costs related to the conclusion of the sale agreement are borne by the buyer. 5. Failure to attend the notarial deed results in the forfeiture of the deposit in favor of the bankruptcy estate. §10 The syndic reserves the right to: 1) cancel the sale or invalidate it without giving reasons; 2) conduct an auction in the event of offers being submitted by more than one offeror; 3) request additional information from offerors or supplement documents. §11 In matters not regulated by these Regulations, the provisions of the Bankruptcy Law and the Civil Code shall apply.
